보훈급여제도는 국가보훈제도가 추구하는 이념에 적극적으로 부합하여야 한다는 점에서 합목정 성의 이념을 충족하여야 한다. 또한 보훈급여의 수준은 보훈대상자와의 관계에서는 물론 일반국민 들에 대한 손실보상제도와 사회보장제도의 수준 이상을 유지해야 한다는 점에서 정의로 표현되는 형평성의 이념을 충족하여야 한다. 전몰·순직군인은 희생 정도가 가장 크다고 할 수 있음에도 그 유족에 대하여 손실보상과 사회보장 성격의 급여로써 지급되는 보훈급여는 상이군인에 대한 보훈급 여의 수준을 하회하고 있는데, 현행 제도는 합목적성과 형평성의 이념과 배치된다. 손실보상의 성 격을 가지는 보훈급여금을 보면, 전몰·순직군인 부모유족 보상금은 상이등급 1급의 상이군인 보상 금의 절반에도 못 미치고, 위자료 성격으로 상이등급 1·2급의 상이군인에게 지급되는 중상이수당 에 상당하는 보상은 마련조차 되어 있지 않다. 의료지원제도에 있어서도, 보훈병원과 위탁병원을 국비지원으로 이용하는 상이군인과 달리 전몰·순직군인 유족은 보훈병원을 이용해야 하고 진료비 용의 60퍼센트만 감면받고 나머지는 본인이 부담해야 한다. 취업지원제도와 교육지원제도에 있어서 도, 전몰·순직군인의 부모유족은 그 대상에서 제외되어 있을 뿐만 아니라, 배우자와 자녀는 대상 에 포함되어 있기는 하지만 대부분 미혼인 의무복무 중 전몰·순직군인의 경우에는 실효성이 없다. 현행 보훈급여제도는 합목적성과 형평성의 이념에 부합하지 않는다. 보훈급여와 의료지원에서 있어 서 1차수급자인 전몰·순직군인 유족 보훈급여는 상이등급 1급의 상이군인과 동일한 수준을 유지 할 수 있도록 개선되어야 한다. 의료지원제도에 있어서 상이군인과 전몰·순직군인 유족을 의료급 여법상 의료급여대상으로 지정하여 모든 의료시설에서 자유롭게 진료를 받을 수 있도록 하는 방법 을 고려할 수 있다. 교육지원제도와 취업지원제도에 있어서도, 전몰·순직군인 유족에 대하여 별도 의 제도를 마련하고, 군복무 중 부양의무자인 자녀를 잃은 부모 유족에 대해서는 양자에 의하여 부 양이 이루어질 수 있도록 양자에게도 교육지원과 취업지원의 범위에 포함시킬 필요가 있다.
Veterans Welfare Systems persue not only the idea that they should provide the proper national compensation corresponding to the contributions and sacrifices the veterans and dead soldiers had dedicated to our country, but also the idea that the veterans and the families of dead soldiers should be treated with respect to let them lead the honorable lives. Even if the war dead soldiers made the noblest sacrifice of all, however, their families were greatly discriminated in comparison with the veterans in loss-compensating benefit and social welfare benefit, which is against the ideas of coincidence with purpose and equity. As a way to solve this problems, firstly, the pay for 1st grade disabled ex-servicemen should be paid equally to the families of war dead soldiers in veterans benefits & medical treatment support system. It should be considered that all the disabled ex-servicemen and the families of war dead soldiers should be accepted as medical care pensioner in Medical Care Assistance Act. In addition, there should be made a special education and job supporting system for the families of war dead soldiers, and the families of war dead soldiers should be allowed to be supported by adopting sons or daughters, who can be also offered the education and job support.
