The Purpose of this study is to explore current situation about
discriminative treatment on contracted teacher using relevant case law and
regulations, and is to suggest improvement plan for each classified
discriminative case. The results of this study can be summarized in the
three types of unjustified discrimination comparing with regular teacher.
First, as legal status, contracted teacher is considered non-fixed legal status
worker between public servant and private worker because he (she) does
not have clearly defined regulation. Second, as service period, contracted
teacher receives unfair treatment; especially, working on vacation, pay and
severance pay, and calculation of career are discriminative treatment
examples. Third, as working conditions, there are much unfair conditions
such as pay step computation, incentive criteria, and the number of leave
days. This study finally suggests legal and institutional improvement plan for
solving irrational discrimination on contracted teacher. Specifically, several
plans are guided considering the analyzed three types of unjustified
discrimination as follows: enacting clearly defined regulation on contracted
teacher’s legal status, implementing rational guideline of contracted
teacher’s system management, executing teacher training for affirmative
awareness on contracted teacher system in school field, and creating
rational school climate for solving discriminative treatment.
