社会福祉法은 伝統的인 市民法의 対立物로서 등장한 社会法의 한 領域으로서 存在하며, 그 주된 法的 指導原理는 市民法上의 자기책임의 原則을 수정하는 集 合的 責任의 原則이며 附随的으로 所有権의 相対原則, 自由契約 制限의 原則 등을 原理로 하는 法이라는 事実이 確認되었다. 이러한 社会福祉法은 内容上 社会 保障法, 社会福祉서비스法, 기타 社会福祉関聯 法律 등으로 그 範疇를 形成하며, 社会保障法은 社会保険法과 公的扶助法으로 구성된다. 이러한 範疇에 包含되는 社会福祉法은 憲法 제10条 및 제34条 제1項을 頂点으 로 하여 法律, 施行令, 施行規則 등으로 垂直的 体系를 이루고 있다. 垂直的인 法体系가 성립되기 위해서는 憲法上 社会福祉給与나 서비스가 國民 個人들의 具 体的인 権利로서 認定되어야 한다. 이러한 垂直的 体系는 社会福祉法의 違憲性 과 違法性을 밝혀내는 道具로 活用될 수 있었다.
Social Welfare Law is a part of Social Law that has been an opposition to traditional civil law. The important principles of Social Welfare Law are the principle of congregational responsibility that amends the principle of self responsibility under the civil law, the relative principle of proprietary rights and the principle of restraint of free contract. Social Welfare Law is consist of Social Security Law, Social welfare service law, other laws that are related with social welfare. Social Security Law is consist of social insurance law and public assistance law. Like this, Social Welfare Law shows vertical system from Article 10, Sub Section 1 of Article 34 of the Constitution to laws, practice orders and practice rules. For the vertical system of law, social welfare benefit and social welfare service are recognized as a concrete right of people. This vertical system is used to examine whether Social Welfare Law violates the Constitution or violates other laws.
