본 연구의 목적은 외국과 우리나라의 부모교육명령제도를 비교해서 살펴봄으로써 외국의 제도가 우리나라 부모교육명령제도에 대해 주는 시사점을 도출하고, 향후 우리나라 부모교육명령제도가 나아갈 발전적인 방향을 제시하고자 하였다. 본 연구는 문헌연구를 통하여 외국과 우리나라의 부모교육명령제도를 분석하였다. 본 연구의 결과, 첫째 외국과 달리 우리나라에는 부모책임법제 자체는 없지만, 부모교육명령제도의 근본이념에는 부모책임이 전제되어 있다는 사실을 알 수 있었다. 외국과 우리나라의 부모교육명령제도는 공통적으로 아동의 행위에 대해서 부모의 역할부실 책임도 있음을 인정하여 아동범죄자의 부모들이 부모교육프로그램에 참여해야 하는 것을 규정하고 있었다. 특히 외국의 경우는 부모교육에 참가하면 처벌을 면제해 주는 조항이 있는 것을 볼 때, 처벌보다는 부모교육의 참여를 강조하고 있음을 알 수 있었다. 둘째, 외국과 우리나라의 문화적인 차이의 관점에서 볼 때, 외국의 부모교육명령제도보다 상대적으로 우리나라의 부모교육명령제도가 더 성공할 가능성이 높은 것으로 나타났다. 셋째, 부모교육명령제도 시행의 결과가 성공적으로 나타나고 있는 현실은 부모교육을 일반아동을 가진 부모에게도 확대 적용할 필요성에 대한 공감대를 형성하는 기초가 될 수 있는 것으로 보인다. 넷째, 최근 도입된 우리나라의 부모교육명령제도가 아동범죄의 재범을 예방하는데 효과적인 기제로 활용되기 위해서는 외국에서 시행되고 있는 제도들의 도입이 필요하다는 것을 알 수 있었다. 본 연구는 최근 도입된 우리나라의 부모교육명령제도에 도움이 될 수 있는 제도나 방향을외국의 제도를 살펴봄으로써 구체적으로 도출해 본데 의미가 있다고 할 수 있다.
The purpose of this study is extracting ideas from examples of Parenting Orders system in the United States of America and England in order to formulate substantial alternatives to the Korean Parenting Orders system. The method of study is done through documentary study. The major ideas of this study was as follows. First, although there are some difference in three-USA, England, korea-countries, \'Parenting Orders\' is based on \'parental responsibility\'. The common content of the \'Parenting Orders\' emphasizes on participating in parenting program rather than punishing parents that did not attend \'parenting program\'. Second, in view of cultural difference, the Korean Parenting Orders system is expected to be more successful than the foreign Parenting Orders system. Third, considering successful result of \'Parenting Program\', \'Parenting Orders\' can be applied to every parents. Fourth, institutional supplement is needed to \'Parenting Orders\' in order to effectively prevent child from committing crime.
