본 연구는 장애 관련법을 중심으로 장애아 교육의 문제점과 개선방안을 제시하면 다음과 같다. 첫째, 장애아의 교육은 누구나 평등하게 교육을 받을 권리에서 출발해야 하며 그 권리를 법적으로 보장한 것을 의미한다. 둘째, 장애아의 교육권을 보장하기 위해서는 법을 이행하는 것이 중요하며, 법은 법제정으로 끝이 아니라 교육권을 보장하기 위한 시작이 되어야 한다. 예를 들면, 정부 또는 교육기관에서 해결해야 할 과제로 필요한 인적․물적․제도적 지원, 실제적 개별화교육 운영, 제한적 환경의 최소화 등에 대한 구체적인 안이 요구되어지고 있다. 셋째, 장애아 교육에 대해 국가차원에서 각종 제도적, 실제적인 재정지원이 적극적으로 이루어져야 한다. 현 시점까지의 지원체계 구축 수준이 교육기관이 자체적으로 수행할 수 있는 능력이 한계라는 점을 인식하고, 국가차원의 재정 확보와 지원만이 장애아 교육 기회확대를 위한 편의시설 확보와 교사․학습지원 시스템 활성화가 가능할 수 있다는 점이다. 이 연구는 장애아 교육환경의 개선방안을 제시하는데 의의를 지닌다.
This study is to provide the problem and improvement of education of disability centering the disability related law. First, the education of disability should be started from the right to educate equally for anyone and this right means that is guaranteed by the law. Second, to guarantee the right to education of Children with disabilities, it is important to conduct the law and the law is not finished by the legislation and it should be the beginning to guarantee the right to education. For example, the detailed suggestion is requested for the personnel and material and institutional supports, practical individualized education management, the minimization of restrictive environment required as the subjects that the government and educational institution should solve. Third, the institutional and practical assistance on the children with disabilities education should be conducted positively by the government. We should recognize that the ability to conduct the support system building by educational institution has a limitation for its level till the present. and the support and ensure of finances are only possible by the government to the convenient facilities and the revitalization of the teacher and learning support system for extension of the opportunity of children with disabilities education. This study has a great significance to suggest the improvement of children with disability educational environment.
