이 논문은 인터넷상의 명예훼손, 모욕행위에 대한 법적 제재수단에 대한 것이다. 인터넷은 이용증가와 더불어 인터넷은 21세기에 있어 ‘가장 참가하기 쉬운 공간’‘가장 자유로운 언론매체’로서 활용되고 있는 것도 사실이다. 어떤 사람은 인터넷 공간은 법적 제재로부터 자유로워야 한다고 주장하기도 하지만 인터넷에서의 행동 역시 법적 제한을 받아야 하는데 그 이유는 피해자에 대한 사이버 폭력, 예를 들면 명예훼손, 모욕 등이 엄연히 존재하고 있기 때문이다. 표현의 자유라는 헌법적 권리도 형법 기타 법률의 제한을 받을 수 밖에 없다. 인터넷상에서도 스포츠맨과 연예인들은 많은 대중의 관심을 받고 있어 그들에게 대중의 명예훼손, 모욕행위가 집중되는 경향이 있다. 네티즌 입장에서는 스트레스 해소용으로 타인을 명예 훼손할지 모르지만, 그 행위로 인하여 피해자는 자살을 하는 사례도 있다.필자는 이 글에서 피해자들이 피해자에 대한 민형사상의 책임을 물을 수 있는 방법 나아가 인터넷 서비스 제공자에게도 민형사책임을 물을 수 있는 방법을 제시하고자 한다.
This article is about some legal sanctions against slander, libel in cyber space. Internet is regarded as the most participatory market place and speech-enhancing medium in the 21th century. Some argue Internet should be set free from legal regulations. But Internet has become a legal regulation, because it has a cyber violence to victims. Such as cyber slander, cyber slander, cyber libel. Freedom of speech also should be regulated by criminal law and so on. Sportsman and entertainer has become targets of cyber slander , cyber libel because many people watch them all day long and sometimes criticize their behaviors. Netizens denounce them just for fun, but the victims sometimes commit a suicide owing to the slander. In this article I suggest some methods of civil and criminal liability to the offenders and Internet Service Providers(ISP).
