“국제물품매매계약에 관한 UN협약”은 대륙법계와 영미법계간의 타협의 산물로서 기존 법체계들의 조정에 초점을 두고 있어 상거래관행의 반영이 미약하고, 법계간의 이해관계로 제외되거나 적용이 배제된 논제들이 많다는 점에서 이를 보충할 법규가 필요하다. 반면 “사법통일을 위한 국제협회”가 제정한 “국제상사계약에 관한 UNIDROIT원칙”은 그 자체가 구속력 있는 협약이 아님에도 불구하고, 국제거래관계에서 그 적용 가능성이 더욱 확대되고 있다. 특히 계약의 성립조항에서도 UNIDROIT원칙은 비엔나협약에 내제된 모순을 보충함으로써 국제상거래 특유의 요구에 가장 적합한 국제적인 보편성을 제시하고 있다.본 연구에서는 국제물품매매계약의 성립과 관련한 비엔나협약과 UNIDROIT원칙상의 규정들을 비교 고찰하여 국제물품매매에서 두 법규의 규정이 함께 공존할 수 있는 가능성을 찾아 보았고, UNIDROIT원칙에서는 기존의 비엔나협약에서 규정하고 있지 않은 새로운 내용들을 다수 포함하고 있는바, 비엔나협약에는 규정되어 있지 않으면서 UNIDROIT원칙에만 규정되어 계약의 성립과 관련하여 기존의 비엔나협약을 보완하여 줄 수 규정들의 내용도 함께 분석하였다.
Recently, sport is inseparably related to individual life it has become a constitute of our society. Also the sports disputes have been expanded. Increasing the sports disputes, the many parties to a dispute would like to solve their disputes at speed, efficient, and secret. The alternative dispute resolut(ADR) as the settlement of sports disputes is regarded as the one of effective dispute resolution methods and merits notice. ADR consists of consultation, inquiry, conciliation, mediation and arbitration. Especially, the sports arbitration system has become preferred means of resolving sport disputes because it has expertness of arbitrators, voluntary reference, speediness, closed proceedings, low costs, and peaceful atmosphere. In 2006, the Korean Sports Arbitration Committee(KSAC) has begun operations and formulated the sports arbitration rule. Therefore, this study focus on the efficiency of arbitration system as the settlement of sports disputes and the task of sports arbitration system in korea.
