The modern post-industrial society, characterized by scientific development and social variety, has developed in a different way from the past. In this kind of society, sports industry has the possibility to expand its domain as the most favored complex industry. The probability is high, considering that sports became a part of people s life. The state is not an exception of this phenomenon. The growing influence of sports industry on national economy emphasizes the role that the state should play to establish related institutions. The more economic, the more important would sports industry grow and the state should support and promote it by law and institution. The present constitution based on liberal and social market economy protects and regulates the economy and industry of the nation. Within the economic order guaranteed by constitution, sports industry has already become one of the major staple industries. Sports industry, including sports manufacture, sports utility and sports service, is essential in contributing itself to national wealth and in providing the base for a healthier life of people. Like other knowledge-based industry, it has abundant economic value and the possibility to grow. It is evident that the state has the responsibility for improving institutional environment in order to promote sports industry. Sports industry policy must be established on a just and legitimate constitutional order which can guarantee and develop the economic life of people. The sports industry of Korea has an infinite possibility to contribute to the national industrial development, linked with other sectors. It will increase employment. Furthermore, it will enlarge the fund for domestic sports development by promoting the production and distribution of sports service. In this process, sports would introduce the characteristics of private enterprises and it is expected that sports will develop through the diversification of sports fund and private resources.
