현대의 후기산업사회는 과학기술의 발달과 사회의 다양성이 어우러지면서 과거의 산업사회와는 전혀 다른 방향으로 전개되고 있다. 스포츠산업은 후기산업사회에서 가장 각광받을 수 있는 복합산업으로 점차 그 영역을 확대하고 있다. 더구나 스포츠가 우리 삶의 일부분이 되면서 이런 현상은 더욱 심화되고 있다. 국가경제에 미치는 스포츠산업의 영향이 증대되고 있는 현실에서 국가가 이를 도외시하거나 제도를 구축하지 않는다면 국가의 의무를 이행하지 않는 것으로 볼 수밖에 없다. 스포츠의 경제성이 강조될수록 스포츠산업의 중요성은 커질 것이고 국가는 당연히 이를 법과 제도로서 뒷받침해야 한다. 현행헌법은 자유시장적 경제질서와 함께 사회적 시장경제질서를 기본 경제체제로 하여 우리 경제와 산업을 보호하고 규율하고 있다. 헌법의 경제질서 속에서 스포츠산업은 이미 우리의 산업 구조에서 중요한 위치를 점하고 있는 기간산업으로 성장하였다. 스포츠제조업, 스포츠시설업, 그리고 스포츠서비스업 등 스포츠산업은 21세기의 국가의 부를 창출하고 국민의 건강한 삶의 바탕이 될 수 있는 중요한 산업이다. 스포츠산업은 여러 다른 지식산업에 못지않게 풍부한 경제적 순기능을 가지고 있으며, 앞으로도 성장잠재력을 갖고 있는 산업이다. 스포츠산업의 활성화와 스포츠산업의 육성을 위한 제도적 장치의 지속적 보완은 스포츠가 오늘날 국가의 중요한 과제가 되었다는 점에서 당연하다. 국가의 스포츠산업정책은 헌법의 질서 내에서 정당성과 합법성에 기초하여 수립되고 추진되어야 하며 이는 국민의 경제생활을 보호하고 발전시키려는 헌법의 과제라고 할 수 있다. 앞으로 우리나라 스포츠산업은 다른 산업분야와 연계되어 무한한 잠재력을 갖고 뻗어나갈 수 있는 분야로서 국가산업발전에 기여할 뿐만 아니라 새로운 사업영역의 개발을 통하여 신규직종에 많은 고용을 창출할 것이다. 또한 스포츠를 매개로 한 재화와 스포츠 서비스의 생산ㆍ유통ㆍ분배의 촉진을 가져와 국내 스포츠 발전을 위한 재원을 확대하는데 기여 할 것이고 민간 기업의 마인드를 스포츠 부문에 적극적으로 도입할 수 있는 기반을 마련함으로써 이를 통하여 스포츠재원의 다변화와 민간 자원에 의한 스포츠의 발전이 이루어질 것으로 기대된다.
The modern post-industrial society, characterized by scientific development and social variety, has developed in a different way from the past. In this kind of society, sports industry has the possibility to expand its domain as the most favored complex industry. The probability is high, considering that sports became a part of people s life. The state is not an exception of this phenomenon. The growing influence of sports industry on national economy emphasizes the role that the state should play to establish related institutions. The more economic, the more important would sports industry grow and the state should support and promote it by law and institution. The present constitution based on liberal and social market economy protects and regulates the economy and industry of the nation. Within the economic order guaranteed by constitution, sports industry has already become one of the major staple industries. Sports industry, including sports manufacture, sports utility and sports service, is essential in contributing itself to national wealth and in providing the base for a healthier life of people. Like other knowledge-based industry, it has abundant economic value and the possibility to grow. It is evident that the state has the responsibility for improving institutional environment in order to promote sports industry. Sports industry policy must be established on a just and legitimate constitutional order which can guarantee and develop the economic life of people. The sports industry of Korea has an infinite possibility to contribute to the national industrial development, linked with other sectors. It will increase employment. Furthermore, it will enlarge the fund for domestic sports development by promoting the production and distribution of sports service. In this process, sports would introduce the characteristics of private enterprises and it is expected that sports will develop through the diversification of sports fund and private resources.
