본 연구에서는 국민체육진흥법 전문개정의 근본적 배경, 즉 왜 어떠한 의도에서 국민체육진흥법을 전문개정 하였는가를 스포츠법사상사적 접근방법으로 정치•경제•사회•문화의 총체적 구조 속에서 국민체육진흥법 전문개정의 직접적인 의도와 배경을 고찰․분석해보고자 하였다. 고찰•분석한 결과 다음과 같은 결론을 얻을 수 있었다. 전문개정의 내용은 표면적으로 국민체육의 진흥과 체육을 통한 국위선양이었지만 실질적인 내용은 ’86•’88 양대회의 준비를 위한 엘리트스포츠의 육성이었다고 할 수 있다. 전두환 정권은’86•’88 양대회의 성공적인 개최를 위해서 1981년 12월 31일 법률 제3535호로 제정된 서울올림픽대회조직위원회지원법 등 특별법 등이 있었음에도 불구하고 국민체육진흥을 위한 기본법적인 성격인 본 법을 엘리트스포츠 육성을 위한 특별법적인 성격으로 변모시켰다.
The purpose of this study was to examine the intention and background of full amendment about National Sports Promotion Act in the Fifth Republic of Korea by analyzing the situation of politics, economics, society, and culture. Through this study, the following conclusion were drawn; Formal content of full amendment was national sports promotion and enhancement of national prestige through sports. However, substantial purpose was upbringing of elite sports for preparation of 86 Seoul Asian Games and 88 Seoul Olympic Games. The main reason of its full amendment was strong political intention. That is, Chun, Doo-Hwan s military government wished the political problem occurred by him settled down soon. He intented to gain more medals in two games for announcement of justification of his government. Since then, the Act has been changed from fundamental law for national sports promotion to special law for upbringing of elite sports.
