선수계약이 다른 고용계약과는 구별되는 특징을 가지고 있는데, 이는 프로스포츠 리그의 운영상 필수적인 구단간의 경기력의 균형유지, 선수에 대한 보수의 적절한 제한을 위하여 시행되는 다양한 제도들에 의하여 그 체결방식과 내용의 결정에 있어서 선수 스스로가 상당히 제한을 받는다는 것이다. 즉 신인선수의 구단선택권을 제한하는 드래프트제도와 계약이 만료된 선수의 이적을 제한하는 보류제도 및 자유계약선수에 대한 보상제도에 의하여 선수 및 구단의 계약체결의 자유가 제한되며, 또한 이러한 제도에 의하여 선수들의 계약교섭력은 현저히 약화되어 실질적으로 선수 보수도 제한되고 법적 지위도 매우 열악하게 되는 것이다. 결국의 이러한 제도들은 위법성의 문제가 제기될 수 있는 것이며 경쟁법적 차원, 즉 독점규제법의 적용대상이 되는 것이다. 특히 드래프트제도는 선수가 계약당사자로서의 지위가 매우 약하다는 것을 드러내는 단적인 예가 된다. 선수와 구단간의 드래프트제도를 통한 계약당사자 지위의 불평등관계로 인해 선수계약은 실질적으로 구단에의 종속관계를 강화시킨다. 그러한 측면에서 선수의 계약체결의 자유가 심각하게 훼손되고, 프로에의 입단을 강력하게 희망하는 선수입장에서는 직업선택의 자유가 현저히 제한되는 것이다. 이러한 계약과정이 구단의 힘의 논리에 의하여 진행됨으로써 구단의 독점적 계약교섭권이 구단에게만 인정되는 불공정성을 있는 것이다. 프로축구에서의 드래프트제도가 특정의 프로구단이 선수들을 독점하는 것을 막음으로써 구단의 선수의 평준화를 통하여 구단의 전력을 균형있게 유지시켜서 스포츠의 발전에 이바지한다는 측면으로 이해하면 매우 긍정적인 것이나, 앞서서 언급한 바와 같이 선수의 입장에서는 매우 불균형적이며 불평등한 구조를 가지고 있어서 법적으로 매우 부당한 요소를 포함하고 있다. 이를 개선하기 위해서는 다각도의 노력이 필요하다고 본다.
In the case of Korea, few systems appeared in professional-sports-player contract, such as the contract reserve system, the free agent system, the assignment of rights, the trade system, the transfer by waiver announcement, and the draft system. From time to time, these contract systems can be a shackle to an individual player. Under the draft system in the Korean football league, players abilities or rights of contract negotiation may become weaker. Actually, the wages of a player is also limited under the system. Furthermore, the system can be related to the problem of the illegal activity under a certain act such as the competition law. According to the competition law, the draft system can be placed in the boundary of the unfair cartel practices. It may make the legal status of a player to the weaker position. If the draft system is still needed to the football league, many parts of the system must be changed for the balance of the legal status between a rookie player and a club. The frame of a contract should be made by the parties. Although there may be some exceptions to this principle for a certain reason, the basic concept cannot be changed. Therefore, some supplements can be added to the Korean system. For example, the draft system which is not related to the mandatory contract with a certain team or the system which provides a player s favourite club for his contract can be one of the possible solutions.
