엔터테인먼트분쟁은 엔터테이너들의 프라이버시와 보호를 위하여 분쟁해결의 비밀성이 보장되어야 하고, 또한 정해진 기간 내에 이루어져야 하는 공연의 신속성을 고려한 분쟁해결이 이루어져야 한다. 특히 연예인전속매니지먼트계약과 관련한 분쟁은 고도화, 상업화 되어가고 있는 연예매니지먼트산업의 발전을 저해하고 연예인과 소속사 양측에 막대한 손해를 끼칠 수 있기 때문에 연예들의 권익을 보호하고 소속사의 피해도 최소화하기 위해서는 무엇보다도 신속하고 경제적인 분쟁해결이 필요하다. 전속계약매니지먼트계약과 관련한 분쟁을 소송에 의해 해결할 경우 연예인들은 다른 직종에 비하여 가동 연한이 짧기 때문에 연예인 본인에게 치명적일 뿐만 아니라, 소속사 역시 많은 피해를 보게 되며, 소송에 있어서는 법관에게 다양한 분야에서 발생하는 엔터테인먼트분쟁의 특성과 내용을 신속히 파악하여 판단할 수 있는 전문성을 기대하기 어렵다. 또한 소송은 재판절차나 판결문이 공개되는 것을 원칙으로 하기 때문에 연예인의 프라이버시 등이 공개될 위험이 있으므로 향후 연예활동에 치명적인 악영향을 끼칠 수 있다. 이러한 이유에서 전속매니지먼트분쟁과 같이 전문적이고 분야의 분쟁을 합리적이고 신속하게 해결할 수 대체적 분쟁해결수단인 중재제도의 효율성이 부각되고 있는데, 이는 신속성과 경제성, 판정의 융통성, 중재인의 전문성 및 중재관련내용의 비밀보장성 등 중재제도 자체가 가지는 효율성에 기인한 것이다.
Today, Entertainment industry is rapidly growing into future-oriented cultural enterprise. With the development of the entertainment industry is growing rapidly dispute about him. This study focus on the efficiency of arbitration system as the settlement of entertainment disputes and the activation of entertainment arbitration system in korea focusing on Contract of Entertainment Management. The popular conception has been that disputes in the entertainment management should be resolved through traditional litigation. On the other hand, the alternative dispute resolut(ADR) as the settlement of entertainment disputes is regarded as the one of effective dispute resolution methods and merits notice. Recently, the arbitration system has become preferred means of resolving entertainment disputes because it has expertness of arbitrators, voluntary reference, speediness, closed proceedings, low costs, and peaceful atmosphere.
