이 연구는 1989년 9월부터 1999년 2월까지 한시적으로 시행된 대중골프장 병설의무제도와 병설의무를 이행하지 못한 골프장 사업자가 출연한 대중골프장 조성비 예치금제도에 대한 현황과 법적인 문제점을 살펴보고자 한다. 또한, 조성비 법인의 운영의 효율화를 기하기 위해 관련 법령의 정비방안을 제시하는데 목적을 두었다. 따라서 이 연구는 다음과 같은 결론을 얻을 수 있었다. 첫째, 현행법의 해석론(de lege lata) 로서는 비록 주식회사 형태로 운영되고 있지만, 대중골프장 조성비로 설립된 법인은 설립 근거가 「체육시설의 설치·이용에 관한 법률시행령」의 규정이고 골프장 대중화라고 하는 공익적 측면이 강조될 수 밖에 없는 연혁적 이유 등에 비추어 현행 법령체계를 전제로 할 때 완전한 민간자율적인 운영을 허용하는 방향으로 해석하는 것은 무리가 따른다고 보여 진다. 결국 입법론적 내지 법정책적 관점(de lege ferenda)에서 접근하는 것이 필요하다. 대중골프장의 병설의무제도가 국민의 재산권침해우려 등의 차원에서 한시적으로 운영되어 왔으나, 이로 인하여 대중골프장이 확산되는 계기로 작용한 점이라거나 조성비로 설립한 법인이 운영하는 대중골프장은 그야말로 저렴한 가격으로 일반인이 이용할 수 있도록 행정적 규제를 좀 더 철저히 하면서 앞에서도 검토한 바와 같이 법치주의의 관점에서 위헌성의 시비를 불식시키면서 입법적으로 미비된 사항을 보완하는 제도개선 노력을 기울일 필요가 있다. 둘째, 대중골프장 조성비 법인의 운영에 관하여 비체계적으로 대응해 오던 행정지도와 감독의 운영현실을 개선하고 바람직한 정책방향을 제시하여 법인의 운영활성화를 꾀하여야 할 것이다. 셋째, 대중골프장 조성비 법인의 경우에는 당초 제도 도입의 취지를 살려 공익적 성격의 법인인 점을 감안하여 통상적인 대중골프장과는 달리 이용료 등에 있어서 적절한 규제를 가하여 이용료의 인하를 도모하고, 이를 통하여 다른 대중골프장에도 적절한 행정지도를 할 수 있는 등 골프의 대중화에 기여하도록 유도하여야 한다. 넷째, 제4법인이 설립되고 골프장이 건설·운영되는 시점에서 조성비법인에 대한 문화체육관광부의 승인제도를 전면 재검토하고, 그 법적 지위도 상법상의 주식회사로 할 것인지 사단법인으로 할 것인지 검토할 필요가 있다.
This research will look at the present condition of the public golf course establishment duty system that was operated from September 1989 to February 1999 and the formation deposit program that the golf course businessman contributed and its legal problem. Also, to perform the operation efficiency of formation foundation, we have aimed at presenting the related law s maintenance plan. Therefore, this study can have the following conclusion. First, as the de lege lata of the existing law, although it is operating as a stock company form, the establishment basis of the foundation established through public golf course formation is 「law operation about physical training equipment s installation and use」rules. Also, based on the present law system of the development reason that the golf course popularization called public good side is emphasized, there is unreasonableness to interpret the allow the total private flexible operation. Finally, it is needed to approach in the legislation or de lege ferenda viewpoint. The public golf course s establishment duty system has operated in the dimension of people s property right violation concern. However, as this point was worked as the chance of spreading public golf course and doing the administrative control more thoroughly so that normal people can use in low price. Also, as examined, the unconstitutional dispute should be stopped in the legalism viewpoint and system improvement effort to complement the lawmaking insufficient matters is needed. Second, for the operation of public golf course formation foundation, the administration guidance and control s operation should be improved. Also, desirable policy direction should be presented and plan operation stimulation. Third, in the case of public golf course formation foundation, system introduction purpose should be kept alive and think it is the public good character foundation. So the rate reduction should be planned by adding appropriate regulation in the rate different from normal public golf course. Through this, the golf popularization should be encouraged to appropriately do administration guidance in other golf courses. Fourth, the 4th foundation should be established and the Ministry of Culture, Sports and Tourism approval system should be reviewed about formation foundation in the time when golf course is constructed and operated. Also, it should be examined the legal status is corporation in commercial law or foundation.
