단일민족으로 구성되었다고 배워왔던 한국사회는 초저출산문제로 인하여 다문화사회라는 단어가 일상의 용어가 되어 버렸다. 다문화가정의 형성과 이로 인한 현실적 문제는 법적으로는 사회법영역 혹은 행정법영역에서 구체적으로 다루어지기에 스포츠법과는 일견 관련 없을 수 있지만, 사실 대중적 의미의 다문화사회의 첫 출발은 스포츠영역에서 시작되었다고 하여도 과언이 아니다. 또한 스포츠 다문화사회에서 가지는 긍정적 사회통합의 기능은 유럽의 경우를 보면 더 잘 알 수 있다 스포츠의 속성상 경쟁 관계 속에서 인간의 흥미를 자극하고 하나로 결속시키는 기능을 하고 있기에 스포츠는 근대인류역사에서 중요한 역할을 하였다. 특히, 다양한 민족과 국가의 이동이 자유로웠던 유럽의 경우 프로스포츠를 중심으로 한 경제활동으로써 스포츠에 대한 개별국가의 규제와 한 국가내의 스포츠 단체의 규정 및 국경을 초월한 스포츠단체의 규정의 해석문제가 대두되면서 EU스포츠법이 발전하게 되었다. EU스포츠법의 발전에서 우리에게 시사점으로 제시될 수 있는 것은 스포츠의 기능을 EU법적으로 명문화해가는 과정일 것이다. 스포츠의 개인적 건강증진과 여가선향기능을 넘어서 사회통합기능과 갈등해소기능을 법체계적으로 포섭하여 스포츠를 활성화하고 육성하려는 EU의 노력은 우리에게도 많은 시사점을 제공하고 있다. 이런 문제에 대한 해결과정으로써 스포츠관련 규정을 헌법차원에서 논의할 필요가 있을 것이다. 물론 헌법개정을 스포츠관련 규정만 대상으로 한다는 것은 누구도 쉽게 동의할 수 없는 것이지만, 헌법개정이 정치체계를 비롯한 기본권부분의 개정으로 확대되어 논의되는 시점에, 다문화사회와 더불어 스포츠의 사회적 기능과 육성을 담아낼 수 있는 헌법조항의 신설과 스포츠기본법의 제정문제를 심각하게 고려해야 할 것이다. 국민의 공감대를 얻지 못한 스포츠다문화사회는 자칫 오히려 더 사회적 통합을 저해하고 스포츠를 오직 흥미와 상업화로 내몰 수 있다는 사실도 염두에 두어야 할 것이다.
Korea has been among the world s most ethnically homogeneous nations. and Korean believe that they have a same ancestor named Dangoon. However, the word multiculturalism is increasingly heard in Korea and Korea is steadily moving toward a multicultural society because of Lowest birthrate in the world. industry of sports is not a exception of multicultural society. During the human history, sports have been transformed into a major human activities and paly a leading at an economic and social level in addition to the benefits they brings to the health of persons involved in th sports. Sports can draw various people who have different background under same interest so that people can share common understanding through sports events. This is confirmed by the millions of individuals participating in various types of physical activity and sports on a professional or amateur basis within the European Union. EU noticed the importance of sports in various fields so that sports law in EU has been developed through cases of ECJ and treaties. The one of great benefits of sports is power of integration under same sports or team sports. The Lisbon Treaty was signed by the EU member states on 13 December 2007, and entered into force on 1 December 2009. TFEU Article 165 expressly mention importance of sports and cooperation for encouraging sports activities. As Korea is about to be semi-muticultural society, the role and importance of sports have to be reviewed. For the integration of mulicultural society, it is time to enact Fundamental Act of Korean Sports and reorganize sports law area. However, we need to careful to allow foreign sportsman to get Korean nationality through naturalization process. the most import thing is to get consensuses and understand of Korean.
