국민들이 보다 안정된 스포츠 활동을 영위할 수 있고, 제도적으로 스포츠안전 시스템을 구축하는 데에 필요한 자료를 제공하기 위하여 국내 현행법 중 스포츠 안전관리 및 규제에 관련된 법률을 고찰한 결과와 그 개선안은 다음과 같다. 첫째, 국내 제정 법률 중 스포츠안전 관련 법률은 모두 14건으로서 이 중 안전을 주 목적으로 하는 법률은 낚시어선업법, 수상레저안전법과 법 제정 목적에서 안전을 명시한 자전거이용 활성화에 관한 법률 등 모두 3건이었고 나머지는 개별법률 조항에 안전 관련 조항이 포함되어 있었으며, 소관부처 또한 산재되어 있었다. 둘째, 스포츠 안전업무를 효율적으로 관리하기 위해서는 소관 부처의 일원화가 필요하며, 이미 대중화되고 스포츠화된 활동은 주무부처인 문화체육관광부에서 일괄 관리할 수 있도록 해야 할 것이다. 셋째, 스포츠 대중화 및 스포츠영역 확대로 스포츠안전을 종합적으로 규제할 수 있는 스포츠안전법(가칭)이 제정되어야 할 것이며 이와 함께 국회에 상정된 ‘레저스포츠 활성화에 관한 법률’이 제정될 수 있도록 관계자의 지속적인 노력이 요구된다. 넷째, 법적으로 안전조항은 명시되었으나 이에 대한 조치사항이 미흡한 기존 법률은 정비 보완되어야 할 것이다.
The purpose of this study is to provide basic data which are helpful to safe sports activities for people and establish of Sports Safety System and we have the results as follows by investigating on the legislation for the Sports Safety in Korea First, the investigation showed that sports safety related act account for 14 cases of total 1,263 statutes of Korea. The 2 cases(Fishing Boats Business Act, Sea and Water Leisure Safety Act) were primary focus of sports safety. And the rest of the laws(12 cases) had a section of the act contains provisions relating to safety. Second, for efficient implementation and synthetic administration of sports safety policy, the administrative departments should be integrated management into the Ministry of Culture, Sports and Tourism. Third, the Sports Safety Act as a whole that can be regulated should be established. And the responsible officials should constantly strive for the establishment of Leisure Sports Promotion Act. Fourth, those sports safety related laws with insufficiency should be modified in order to be operated with their original purposes and objects.
