이 논문은 문헌연구를 통하여 학생선수 안전권의 이론적 고찰과 학생선수 안전권 보호정책의 실태를 분석하고 미흡한 점에 대한 대처방안을 제시하여 학생선수의 보다 인간다운 삶을 영위할 수 있도록 하는데 그 목적이 있다. 학생선수들에게 안전권을 신장시킬 수 있는 법적·정책적인 개선방안을 다음과 같이 제시하였다. 첫째, 학생선수의 안전권 보호정책에 대한 인식전환이 필요하며, 그 인식하에 학생선수의 안전권 보호정책을 개선시켜야 한다. 둘째, 학생선수의 안전을 보장하기위해서는 보다 체계적이고 예방적인 안전을 위한 ‘학교체육진흥법(안)’ 등 스포츠안전 관련법을 제·개정하여야 한다. 셋째, 학생선수들이 참여하는 스포츠행사의 안전한 운영을 위한 스포츠안전 매뉴얼을 규정하고, 스포츠안전에 관한 교육을 강화하여야 한다. 넷째, 학생선수의 인성교육 강화를 위한 방법으로 효행 인성교육 프로그램을 개발·운영하여야 한다. 다섯째, 학교 및 체육시설의 안전대책을 강구하여야 한다. 끝으로 그 무엇보다도 학생선수의 인권침해가 발생되지 않도록 예방이 중요하다는 점이며 어른들의 책임과 의무에 최선을 다해야 함을 명심해야 할 일이다.
This study is to lead student athletes more like human beings by analyzing the theoretical contemplation of the student athletes and actual condition of their safety right protective policy through study on literature and by suggesting plans to deal with for its shortcomings. The legal·policy information and effective counterplan to boost the student athletes safety right like human right etc are suggested as follows. First, classifying the student athletes safety right into personal security right and right to health or health care right, the protective policy of safety right must be improved. Second, sports safety related laws like the school sports promotion act (or plan), etc. for more systematic and preventive safety must be enacted or reformed. Third, regulating the manual of sports safety for safe operation of sports events, the education about the sports safety must be strengthened. Fourth, The program as a measure of filial piety personality education strengthening the personality education of sports men and women must be developed and conducted. Fifth, the safety measure of school facilities and youth training camp facilities must be taken. Lastly, above all, the prevention of student athletes human rights abuse is important and doing the best for the adult s responsibilities and duties must be sure to remember.
