인기스포츠 연맹들은 수익극대화를 위하여 방송사 컨소시엄을 무력화하고, 보편적 시청권 규제에 대해 문제제기를 하고 있다. 소수의 인기 콘텐츠 공급자와 다수의 방송플랫폼이라는 다채널방송환경에서 보편적 시청권 규제와 방송사 컨소시엄만으로는 효율적인 대처가 힘든 것이 사실이다. 유료방송사업자의 독점이 문제인 유럽에서는 보편적 시청권규제와 반독점규제가 동시에 실시되고, 다양한 스포츠와 방송이 존재하는 미국에서는 보편적 시청권규제보다는 공정경쟁규제가 실시되고 있다. 한국의 프로스포츠는 편향적 독과점구조를, 방송체제도 강력한 지상파독과점시장구조를 지니고 있다. 유럽과 같이 유료방송사업자의 스포츠방송권 독점을 우려하여 보편적 시청권 규제를 실시하였으나, 현실적으로 실효성은 의문이다. 이에 한국적 스포츠와 방송현실에 맞게끔 제도정비를 할 필요가 있다. 첫째, 반독점규제에 관심을 기울일 필요가 있다. 인기스포츠연맹의 공급자카르텔이 지니는 독점적 지위에 관심을 기울여야 한다. 둘째, 한국방송단과 같은 방송컨소시엄 방식을 새롭게 재편할 필요가 있다. 셋째, 보편적 시청권 규제에서 과도한 시장개입 관련조항들을 개정해야 한다.
The Popular Prosports Federations are raising issues about the universal access and broadcasters consortium as like Korea Pool. In a multi-channel broadcasting environment, only broadcasters consortium and universal access regulation is difficult the effective measures to cope with the popular prosports federations. In Europe, universal acess and anti-monopoy regulation are being conducted at the same time, in the United States, anti-monopoy regulation rather than universal acess regulation are being conducted. In Korea, First, We should propose about anti-monopoy regulation issues in the popular prosports federations. Second, broadcasters consortium such as Korea Pool should be reorganized. Third, the universal access regulation provisions related to excessive market intervention should be revised.
