2011년 12월 30일 국회본회의를 통과한 학교체육진흥법이 2012년 1월 26일 공포되어 2013년 1월 27일부터 시행될 예정이다. 그 동안 입시위주의 교육으로 체육활동이 경시되어 국가미래의 주역인 청소년들의 체력저하가 심각한 사회현상으로 대두되고 있으며, 학생선수들의 학습권과 인권의 보장이 지속적으로 요구되어 왔다. 이러한 학교체육을 정상화시키고 학생들이 건강하고 균형 잡힌 신체와 정신을 함양하기 위하여 <학교체육진흥법>이 제정된 것이다. 이법의 시행을 위해 많은 준비가 필요하다. 우선 이법에서 위임된 사항이나 법집행에 필요한 시행령, 시행규칙, 조례 등 하위법령을 올바르게 제정하는 일이 가장 중요한 과제이다. 아울러 제도를 실질적으로 뒷받침할 예산의 확보와 함께 이 분야의 인적자원의 육성과 확보 방안이 수립되어야 할 시점이다. 따라서 이 글에서는 학교체육진흥법의 시행을 위한 하위법령 제정의 과제를 개괄적으로 정리해 보고자 한다. 우선 학교체육진흥법이 제정되어 학교체육의 새로운 비전이 제시되고 발전방안이 모색되어야한다는 점을 강조하였다. 이 법 시행의 주관부처인 문화체육관광부와 교육과학기술부가 원활한 협조체계를 구성하여 학생선수, 일반학생 대상 체육활동, 시설 및 인적 인프라 조성 등 시급히 요청되는 다양한 세부사업을 추진하고 있어 다행스러운 일이다. 하지만, 학교체육의 정상화를 위해 기존에 산재된 문제의 조속한 해결을 위해 보다 많은 노력이 필요한 것도 사실이다. 학생선수에게 보장되는 학습권과 함께 일반학생 모두에 체육교육을 받을 권리를 보장하며, 학교폭력을 근절시키는데 공헌할 수 있도록 내실있는 체육교과의 운영이 시급하다. 학교운동부와 체육특기자 양성, 교사양성과 교육, 비만 및 체력저하, 학생의 균형적 성장 발달 전략, 학교체육진흥의 평가와 활용(특히 각급학교 평가와 입시반영 등) 등 현안문제를 해결해 가는데 학교체육진흥법의 하위법령을 잘 마련하는 것은 대단히 중요하다. 각계각층의 의견을 잘 수렴하여 선진적인 제도적인 기틀이 되어주길 기대한다.
This paper focuses on the implication and the challenges in the enactment of the School Physical Education Promotion Act, which was passed by the National Assembly on December 30, 2011, promulgated on January 21st of this year, and planned to be enforced on January 27, 2013. The physical deterioration in the youths has become a serious social phenomenon, due to the nation s test-centered education. Also, the student athletes’ guaranteed rights for learning and human rights have been demanded. Therefore, the School Physical Education Promotion Acthas been enacted in order to normalize the school physical education and to develop health and balanced body and mind in students. Future challenges, such as 1) enactment of right sub-regulation (enforcement ordinance, enforcement regulations, and ordinance), 2)the guarantee of student athletes rights for learning and human rights which include minimum education, 3) The guaranteed rights and quality recognition of the person in charge of the school sports (athletic director of the school, and sports trainer), 4) financing for normalization of school physical education, 5) proper organization and operation of School Physical Education Promotion Committee, 6) organization and operation of School Physical Education Promotion Committee, 7) strengthening the school administration in physical education, and 8) the prevention of possible future threats in facility and expansion of the facility are also presented. The most important challenge, from this point on, is to mandate the matters in this act andthe enactment of the sub-regulation to be enforced such as enforcement ordinance, enforcement regulations, and ordinances, within a year of preparation period before the law takes its effect.
