국민소득수준의 향상으로 여가활동으로 낚시를 즐기는 낚시인구가 폭발적으로 증가함과 동시에 동적인 바다낚시가 인기를 끌면서 낚시도 스포츠의 하나라는 인식이 확산되고 있다. 이러한 낚시의 긍정적 측면과 더불어 환경오염과 어족자원의 감소라는 부정적인 측면의 문제도 함께 발생되고 있다. 따라서 제반 문제들을 효율적으로 관리하고자 정부는 ‘낚시 관리 및 육성법’을 제정하여 2012년 9월부터 시행에 들어갔다. 그동안 여러 법들에서 산발적으로 존재하고 있던 낚시 관련 규정을 한곳으로 모아서 하나의 부처에서 체계적으로 관리한다는 점과 낚시의 육성 측면도 고려하고 있기 때문에, 많은 낚시인들이 동법의 시행을 반겼으나, 몇몇 규정들에서 심각한 문제점들이 나타나면서 시행초기부터 낚시인들의 거센 반발을 일으키고 있다. 유럽이나 미국 등 서구의 선진국에서는 환경오염을 방지하면서도 어족자원을 효율적으로 관리함과 동시에, 여가활동으로서의 낚시를 지원하기 위해 낚시면허제도를 오래전부터 유지하고 있다. 이러한 낚시면허제도는 현재 당면한 여러 문제들을 효율적으로 처리하기에 반드시 필요한 제도로써, 최근 시행된 ‘낚시 관리 및 육성법’을 계기로 다시 도입 필요성이 대두되고 있다. 따라서 본 논문에서는 ‘낚시 관리 및 육성법’의 내용과 문제점을 살펴본 뒤에, 미국 워싱턴주의 낚시면허제도를 살펴보고, 이러한 낚시면허제도가 어떻게 동법과 조화를 이룰 수 있으며, 한국에 적합한 낚시면허제도가 갖추어야할 사항들이 무엇인지에 대해 기술하고 있다.
Due to the increase of national income, fish population enjoying fishing increases explosively and at the same time, as dynamic saltwater fishing gets popularity, the recognition that fishing is also a kind of sports is spread. The problem of negative aspect, the environmental contamination and the reduction of fish resource in addition to positive aspect of fishing are occurred concurrently. Accordingly, in order to manage whole problems efficiently, the government enforced the implementation by enacting the Act on Recreational Fishing Management and Development since September 2012. Since the point that manage systematically fishing related regulations which have been sporadically existed in many laws in one ministry and the growth aspect of fishing are considered, many persons enjoying fishing welcomed the enforcement of this law but as serious problems of some regulations are occurred, they oppose to this law. Western advanced countries such as European countries and U.S. manage fish resources efficiently while prevent the environmental contamination. And at the same time, they maintain fishing license system from a long time ago in order to support the fishing as a leisure. Such fishing license is a system needed to deal with facing various problems efficiently and its necessity to introduce it as recently enforced the Act on Recreational Fishing Management and Development is raised. Therefore, this article describes how such fishing license harmonizes with above law and what are things which fishing license fit to Korean situation should equip by searching a fishing license system in Washington, U.S. after researching the Act on Recreational Fishing Management and Development and its problems.
