스포츠상해사건은 때로는 민사법률규범이의 규율을 받지 않는 “법외공간”이 될 수 없고 스포츠상해사건에 대하여 응당 과실책임의 원칙을 적용하여야 한다. 그러나 이러한 민사법률규범의 스포츠영역에서의 적용은 스포츠의 자치성에 영향을 미치게 된다. 따라서 민사법률규범의 스포츠영역에로의 과도한 개입을 방지하기 위하여 피해자의 동의와 자원모험의 두가지 면책사유가 스포츠자치와 사법개입간에 조화역할을 한다고 하겠다. 이 두가지 면책사유는 그 적용에 있어서 선후절차가 있고 각각 다른 적용범위가 있으며, 적용하는 법률의 효과도 꼭 같지 않다.
