심판은 모든 경기에서 헌법상 평등의 원칙에 입각한 공정한 심판을 하여야 한다. 심판의 공정한 판정이 보장될 때 비로소 스포츠참여자는 인간의 존엄과 가치는 물론 이를 통하여 행복을 추구할 권리가 보장된다. 이와 반대로 심판의 불공정한 판정은 스포츠 참여자에게 보장된 스포츠 활동의 자유를 침해하는 결과를 낳는다. 이 문제를 해결하기 위해서는 심판의 판정결과에 대한 사후적 조치를 취하기보다는 심판양성과 재교육 실행 강화 등과 같은 심판 자질의 향상이라는 사전적 조치를 취해야한다. 그리고 심판의 양성과 재교육을 운영하는 주체라 할 수 있는 각 종목별 체육단체에 대한 투명한 운영과 회계관리 등이 뒷받침되어야한다. 그렇지 않다면 심판의 공정성 확보를 위한 정책의 동력은 제한적일 수밖에 없다.
Referees need judge that is impartial and principled constitutional equality. When fair judgement of referees is assured sports participants are guaranteed not only the dignity and value of human being but also the right to pursue happiness. On the contrary, unfair judgement of referees brings out invasion of liberty of sports activities guaranteed to sport participants. To resolve this matters, it is necessary that previous measures for training referee and quality improvement of referees through intensification of reeducation rather than further measures about judgement result. And, each of athletic organizations which manage training and reeducation of referee should support transparent management and accounting. Without this, power of the policy for ensuring the fairness of referees has no choice but to restrict, so normalization of athletic organizations is essential.
