최근에 사행산업은 세계적으로 높은 성장률을 보이면서 크게 확산되고 있다. 특히 인터넷환경의변화에 의한 불법도박의 폭증은 매우 심각한 사회적 문제로 대두되었고 이에 대응한 여러 입법이이루어지기도 하였다. 그럼에도 불구하고 도박이 확대되고 있는 이유는 21세기에 들어서면서 도박환경의 요소인 사행성에 대한 규범의식과 도박이 가능한 공간에의 접근성이 변화하였기 때문인 것으로 보인다. 인터넷을 이용하여 시공간의 제약을 벗어나 다양한 문화와 경제를 소통할 수 있는 열린 환경은사행성에 대한 규범의식을 약화시키고 인터넷도박콘텐츠에 매우 쉽게 접근할 수 있게 한다. 생활환경에서 도박을 제어할 수 있는 요소로써 접근성과 규범인식이 이미 붕괴되었기에 도박의 확산은필연적이다. 그러므로 현대사회의 사행산업에 관한 문제를 보수적 규범의식에 기반하여 전통적 규제방식으로 해결하려는 태도는 불법도박의 문제를 악화시키기만 한다. 오히려 적극적으로 사행사업 인허가제도를 도입하여 불법도박의 폐해를 관리하고 음성화된 불법도박을 양성화하여 국가재정의 보충과 사회적 약자를 돕는 기금의 조성을 가능하게 하는 방안을 검토할 필요가 있다. 불법도박을 합법적 사행산업화로 광범위하게 유도하기 위해서, 도박 전반에 대한 인허가제도와함께 합법도박사업의 영업에 대한 규제와 관리시스템을 세밀하게 마련하여야 한다. 합법도박영업이 불법도박을 유인하면서도 영업의 철저한 준법성을 유지할 뿐만 아니라, 이용자에 대한 도박사업자의 관리책임 등 사행산업의 사회적 책임에 대한 실현을 구체화하는 체계도 구축하여야 한다.
Nowadays Speculation Businesses have become a popular object of worldwide depression in business. However we are helpless against the spread of unlawful gambling. And the expansion of unlawful gambling make matters worse. New statute requires that the internet gambling be unlawful. But today a powerful prohibition has no effect on unlawful gambling at all. The temptation for good citizens to ignore a stupid law is encouraged when it is unenforceable. So I believe in the ideas that we must recognize, limitations of a powerful prohibition, a change in sense of unlawful gambling, practical use of speculation businesses. Specially, a norm consciousness and accessibility on the online or mobile caused new conflicts to speculation businesses or unlawful gambling. In policy of legislation, the conservative regulations of speculation businesses overlook the globalization of internet, most importantly, practical effects of regulation on multiplicity, freedom and infinite space in internet. Historically society has troubled about gambling. But a matter of consequence is not a habitual gambling but a wasteful gambling. We should consider the fact that a matter of speculation businesses is on not gambling but overconsumption. Legality of the habitual gambling is on the reasonability of consumption. I think that gambling goes wrong with a time-honored controllers. And the new controller is the receptive capacity of unlawful gambling. A heart of the receptive capacity is the authorization system of unlawful gambling on capacity of management and control inspection.
