본 고에서는 지방정부의 장애인체육 진흥 정책 추진에 실질적인 도움을 줄 수 있도록 장애인체육 진흥 조례 정비방안을 제시하기 위하여 시도별 장애인체육 진흥 조례를 고찰한 결과 다음과 같은 결론을 얻었다. 우리나라 17개 시도 중 13개 시도, 229개 시군구 중 72개 시군구에서 장애인체육 진흥 조례를제정운영하고 있었으며, 조례 제정의 법적 근거로는 국민체육진흥법 제13조, 장애인복지법 제28조, 제29조, 장애인차별금지 및 권리구제 등에 관한 법률 제25조를 들고 있다. 조례는 개별형인 장애인체육 진흥 조례와 통합형인 체육진흥 조례로 제정되어 있으며 조례는위임조례와 필수조례 성격을 가지고 있음에도 실제적으로는 형식적, 선언적 조례로서 이에 대한정비가 요구된다. 또한 일반 체육 분야와의 시너지 효과를 위해서는 개별형보다는 통합형 조례가 바람직하며 통합형 조례로 추진할 경우 단순한 형식상의 통폐합이 아니라 내용상 일관성이 유지되어야 할 것이다. 구속력 있는 장애인체육 진흥 정책 추진을 위해서는 장애인체육 진흥계획의 수립, 장애인체육편의제공 조항을 개제정할 필요가 있다. 또한 재정 지원 조항은 선택형이 아닌 필수형으로 개정되어야 만이 실효성 있는 조례로서 역할을 할 수 있다. 또한 지역실정에 적합한 장애인체육 진흥 정책을 발굴하고 추진할 수 있도록 조례가 검토되어야 할 것이다.
The purpose of this study is to present the development plan of the handicapped sports promotion ordinance through Disabled Sports Promotion Ordinance discussion of local ordinance of 13. Legal basis of handicapped sports promotion ordinance is on the National Sports Promotion Act Article 13, Disabled Persons Welfare Law Article 28, Article 29, Disability Discrimination and the Right Relief Law Article 25. The local ordinance have been enacted in individual types(Disabled Sports Promotion Ordinance) and integration(Physical Education Promotion Ordinance). Features of the ordinance is not the intention of running has been established in terms of declaration, it is necessary for this maintenance. To produce a synergistic effect in sport, not the individual types, integrated ordinance, was found to be better. When amending the integrated local ordinance, it must ensure consistency in the contents is maintained. Disabled Sports Promotion Ordinance in order to be able to practice that there is a need to amend the clause that provides the handicapped sports convenience and disabled sports promotion plan. In addition, the clause of financial support is not selectable, should be amended to the required type. The local ordinance is considered to be able to promote the handicapped sports promotion policy that is appropriate to local circumstances.
