스포츠단체의 운영은 스포츠에 내재된 가치인 정의를 수호하는 범주에서 진행되어져야 한다. 그러한 측면에서 스포츠단체가 주지하고 있는 근본규칙인 정관은 매우 중요하다. 스포츠 조직 및 활동을 정한 근본규칙을 통하여 단체는 자신의 활동을 합리화시키고 있다. 최근 논의되는 대한체육회와 국민체육진흥회의 통합을 위한 절차에서 정관의 정비는 향후 우리나라 스포츠단체의 건전성과 발전상을 보여주는 결정적인 단면이 될 것이어서 지대한 관심이 가지지 않을 수 없다. 현재 가칭 통합체육회 설립을 앞두고 설립근거에 맞는 정관작성의 작업 중에 있다. 통합체육회의 설립은대한체육회와 국민생활체육회의 개개 회원이나 조직적 이해관계를 조정하는 것을 우선하면 안 된다. 본질적으로 통합체육회가 나아가야 할 설립목적을 준수하는 것을 제일 우선시하여야 한다. 통합체육회는 체육운동의 범국민화를 위하여 학교체육, 생활체육 그리고 전문체육에 이르기까지 국가적인 임무를 수행하기 위한 단체이다. 더불어 우수 체육단체를 지원육성하고 전문경기인을 양성하여 국위선양을 하기 위한 목적을 근간으로 설립되어야 한다. 그러므로 통합과정에서 발생하는양 사단법인의 일반목적은 철저히 배제되어야 한다. 정관에서 아직 그 실체를 드러내지 못하고 있는 회원구성과 그 권리의무를 확정하는 문제가 현재로서는 가장 시급한 문제이다. 또한 통합체육회를 설립과 유지를 위하여 스포츠정신에 입각한 자율성을 바탕으로 투명성, 공정성이 반드시 제고되어야 하므로 기본정신을 저해할 만한 내용의 정관을 그 내용으로 해서는 안 된다. 이를 위해서는 각 단체를 대변한 전문가구성도 매우 중요하지만 양 단체와는 무관하게 독립적이며 중립적인 위치에 있는 전문가와 실무가를 전문위원회의 위원으로 적극적으로 배치하여야 한다. 이는 가칭 통합체육회의 미래가 달린 사항이기도 하다. 또한 스포츠가 가지는 특수성을 고려하여 스포츠관련 분쟁이 발생하는 경우 이 분쟁을 해결하는 한 방안으로 스포츠중재국내지 스포츠조정국의 설립이 필요하다고 본다. 그러한 측면에서 정관에 가칭 ‘스포츠옴브즈만’ 이나 ‘스포츠조정국’ 또는 ‘스포츠분쟁조정위원회’를 둘 것을 제안한다. 기본적으로 스포츠경기와 직접 관련된 분쟁이 있을 수도 있지만 최근에는 스포츠가 산업화되어 스포츠산업에서의 분쟁도 많다. 이러한 일련의 문제는 스포츠특수성이 고려되어져야 하므로 조정이나 중재 등을 통하여 스포츠분쟁을 해결하는 것이 바람직하다고 판단된다. 그러한 측면에서 이에관한 사항도 원시정관을 만드는 과정에서 포함시켜야 하는 내용이라고 본다.

Thus, the general object of the companies that occurs in the combination process has to be completely ruled out. In the articles of association still have problems confirming membership and the rights and obligations that did not reveal the reality at present is the most urgent problem. In addition to the establishment and maintenance of the Combined Sports Council, based on transparency, autonomy, based on sportsmanship, and fairness it must be enhanced.
