본 연구는 대한민국 법률에서 정의한 체육･스포츠･무도 용어에 대한 고찰과 그 개념에 관한 입법적 방안을 모색하기 위한 것이다. 1962년 이후 제정된 법률 중에서 용어나 내용상 체육･스포츠･무도에 관한 법률을 비롯하여 법률 제정 및 개정과정에서 발행된 문헌을 심층적으로 고찰하여 다음과 같은 결론에 도달하게 되었다. 첫째, 1962년 제정된 국민체육진흥법 제2조에 규정된 체육에 관한 정의가 체육･스포츠･무도와 관련하여 법 영역에서 등장한 최초의 개념이다. 동법률 제2조 1호에서는 체육을 운동경기를 비롯하여 야외활동 등 신체활동을 통하여 건전한 신체와 정신을 기르고 여가를 선용하는 것으로 정의하여 체육의 범위를 체육뿐만 아니라 스포츠, 레저, 레크리에이션 등 다양한 신체활동과 유사개념을 포괄적으로 정의하고 있다. 이후 제정된 체육시설의 설치･이용에 관한 법률, 학교체육진흥법 등에서 사용된 체육의 개념은 스포츠, 무도 기타 다양한 의미로 사용되었다. 둘째, 스포츠에 관한 법적 정의는 2007년 제정된 스포츠산업진흥법 제2조 정의규정에서 최초로 등장한다. 동법 제2조 1호에서는 스포츠를 건강한 신체를 기르고 건전한 정신을 함양하며 질 높은 삶을 위하여 자발적으로 행하는 신체활동을 기반으로 하는 사회문화적 행태로 정의하여, 스포츠의 개념 속에 체육의 개념을 포함하면서도 스포츠를 문화적 형태의 하나로서 규정하고 있다. 이처럼 스포츠가 체육을 포괄하게 되는 개념 역전현상이 나타난 것은 86･88 양대 국제스포츠행사를 개최하는 과정에서 각종 스포츠가 생활체육으로 대중 속에서 광범위하게 확대된 결과를 반영한 것으로 볼 수 있다. 셋째, 무도와 관련한 법적 정의는 2008년 제정된 전통무예진흥법에 최초로 등장한다. 동법 제2조 1호는 전통무예를 무(武)적 공법･기법, 격투체계로 정의함으로써 무예 속에 무술과 무도를 포함하여 전통무예를 정의하고 있다. 이는 80년대 이후 대학가를 중심으로 확대된 전통문화에 대한 관심과 수요의 증가가 법률제정으로 이어진 것으로 보인다. 한편, 2007년 제정된 태권도 진흥 및 태권도공원 조성 등에 관한 법률 제1조(목적)에서는 태권도를 우리 고유무도(武道)로 정의하면서도 태권도를 세계적인 무도 및 스포츠라고 하여, 무도와 스포츠를 병렬적으로 규정함으로써 무도와 스포츠가 서로 이질적인 영역임을 시사하고 있다. 이와 같이 법률 속에 규정된 체육･스포츠･무도 개념은 그 경계가 명확하게 구분되지 않은 채 혼용되거나 시대에 따라 포함관계가 변하고 있어 용어의 혼란을 초래하고 있다. 좀 더 정치(精緻)한 용어의 정의를 위해서는 법률제정 및 제정과정에서 체육･스포츠･무도에 관한 학문적 정의와 학계의 견해가 충분히 반영되어야 할 것으로 판단된다.
This study is to analysis the terms defined in the Acts and to grope for the legislative measures for the concept related with the words; Physical Education, Sports and Martial Arts. I examined deeply the articles and clauses of the Laws which were enacted from 1962 and several theses. The results are as follows: First, they have enacted the legal definition of the Physical Education firstly in the National Sports Promotion Act. It says “Physical Education means the developing of a healthy mind and body, and the effective use of leisure time through competitive sports, outdoor exercise and other physical activities” in article 2(1). It includes various activities and similar concept not only physical education but also sports, leasure and recreation. Second, the legal definition of the Sports was appeared firstly in the Sports Industry Promotion Act which was enacted 2007. It says “Sports means any sociocultural behavior, mainly featuring physical activities conducted on a voluntary basis to maintain a healthy body and achieve a sound mind for the purpose of enjoying an outstanding quality of life” in article 2(1). It sets forth sports as a sociocultural patterns as including the concept of the physical education in it of the sports. We can guess that the sports dispread in the ‘Sport for all’ after Asian games in 1986 and Olympic games in 1988. Third, the legal definition of the Martial Arts was appeared firstly in the Promotion of Traditional Martial Arts Act which was enacted 2008. It says “Traditional martial arts means martial skills, techniques, and systems for attack and fighting that have been created and systemized domestically or introduced from abroad and creatively formalized and systemized domestically, which are recognized as having traditional and cultural value worth promoting at the State level” in Article 2(1). I can guess that the increase of the attention and demand on the traditional culture make them this act. And I founded that the legal definition of the Physical Education, Sports and Martial Arts were used inaccurately. I think they need to reflect academic definition when they enact the laws about the Physical Education, Sports and Martial Arts to make the definition more accurately.
