This study is to analysis the terms defined in the Acts and to grope for the legislative measures for the concept related with the words; Physical Education, Sports and Martial Arts. I examined deeply the articles and clauses of the Laws which were enacted from 1962 and several theses. The results are as follows: First, they have enacted the legal definition of the Physical Education firstly in the National Sports Promotion Act. It says “Physical Education means the developing of a healthy mind and body, and the effective use of leisure time through competitive sports, outdoor exercise and other physical activities” in article 2(1). It includes various activities and similar concept not only physical education but also sports, leasure and recreation. Second, the legal definition of the Sports was appeared firstly in the Sports Industry Promotion Act which was enacted 2007. It says “Sports means any sociocultural behavior, mainly featuring physical activities conducted on a voluntary basis to maintain a healthy body and achieve a sound mind for the purpose of enjoying an outstanding quality of life” in article 2(1). It sets forth sports as a sociocultural patterns as including the concept of the physical education in it of the sports. We can guess that the sports dispread in the ‘Sport for all’ after Asian games in 1986 and Olympic games in 1988. Third, the legal definition of the Martial Arts was appeared firstly in the Promotion of Traditional Martial Arts Act which was enacted 2008. It says “Traditional martial arts means martial skills, techniques, and systems for attack and fighting that have been created and systemized domestically or introduced from abroad and creatively formalized and systemized domestically, which are recognized as having traditional and cultural value worth promoting at the State level” in Article 2(1). I can guess that the increase of the attention and demand on the traditional culture make them this act. And I founded that the legal definition of the Physical Education, Sports and Martial Arts were used inaccurately. I think they need to reflect academic definition when they enact the laws about the Physical Education, Sports and Martial Arts to make the definition more accurately.
