이 논문은 국가적 차원의 바둑진흥의 입법적 방안에 관하여 고찰한 것으로, 특히 2016년 8월에 국회에 제출된 조훈현 의원 대표발의의 바둑진흥법안을 중심으로 그 제정필요성의 관점에서 법적으로 검토한 것이다. 바둑은 우리의 전통문화의 일종으로 고유한 정신 가치 체계를 갖고 있는 두뇌스포츠의 한 분야이다. 이와 같은 스포츠적 요소를 지니는 바둑문화를 계승발전시키고 이를 차세대에 전승하여 미래세대 역시 바둑문화를 향유하도록 할 필요가 있다. 또한 바둑은 나이와 세대를 넘어 남녀노소를 불문하고 노소동락(老少同樂)할 수 있는 몰입성이 높은 스포츠이다. 이러한 관점에서 바둑진흥은 문화국가원리의 헌법적 요청이며, 바둑진흥은 국가의 의무라고 할 것이다. 조훈현 의원 대표발의의 바둑진흥법안은 총 21개 조문과 부칙으로 구성되어 있으며, 전체적으로 바람직한 내용으로 되어 있어 그 내용에 적극 찬동하나, 세부적인 규율과 관련하여 바둑진흥법안의 국회통과를 위해 수정과 보완이 필요한 일부 내용을 검토하고 분석하였다. 장차 국회에서 바둑진흥법이 제정된다면, 바둑지도자의 공인자격제도, 한국기원의 법정법인화, 바둑단체 및 시설에 대한 행정적 재정적 지원, 한국바둑의 국제교류와 해외확산을 도모하는 등 한국바둑의 새로운 전환점을 맞이하여 한국의 바둑이 해외에 적극 전파하는 계기가 될 것이다. 끝으로 이 논문에서 2017년에 반드시 바둑진흥법이 제정될 필요가 있다는 점을 다시금 강조한다.
This paper studies the Legal Measures of Baduk Promotion in Korea. Especially, this study is centered on the draft of the Act on Baduk Promotion proposed by Congressman Hoonhyun Cho, etc. to the National Assembly in August 2016. Baduk, one of Korean traditional cultures, is a kind of mind sports containing the mental value system inherent in Korean people. Tradition of such Baduk culture to next generations, can be enjoyed by future generations. Baduk is a entertaining sport that can be enjoyed beyond age and generations. From this perspective, Promoting of Baduk can be found in the fact that it is a constitutional request and a national obligation as well. The draft of the Act on Baduk Promotion proposed by Congressman Hoonhyun Cho, etc. consists of a total of 21 articles and appendices. In general, its contents are desirable and acceptable. But, some of its provisions are required to be corrected or complemented for passing the National Assembly. This paper has studied and analyzed them. In future, when an Act for promoting Baduk is legislated, it will serve as a good momentum for accelerating setup of the public certification system for Baduk qualified leaders, legal incorporation of the Korea Baduk Association, administrative and financial supports for concerned organizations and facilities, international exchanges and advances, etc. and realizing another turningpoint of the Korean Baduk and spreading the Korean Baduk as Korean cultural goods throughout the world. In conclusion, this paper strongly emphasizes that tthe necessity of legislation Baduk promoting Law in 2017.
