본 연구는 여학생 체육 활성화를 위해 한국형 양성평등체육법 제정에 관한 논의가 활발히 이루어지고 있는 시점에서 기존의 양성평등 관련법들이 체육활동에서의 양성평등에 실질적으로 기여하지 못한 원인을 찾는데 있다. 이를 위해 여학생 체육 활성화에 있어 성공적인 사례가 된 미국의 남녀교육균등법에 대한 탐색 과정을 통하여 성공 요인을 확인하고, 한국에 적합하고 실효성 있는 법 제정에 도움이 될 수 있는 시사점을 제공하고자 하였다. 이를 위해 미국의 남녀교육균등법과 관련된 내용 중에서 성공 요인을 탐색하였다. 성공 요인으로 법의 제정 과정에서는 법이 만들어진 성립 배경, 시행 과정에서는 기관별 역할과 학교 현장에서의 적용으로 나누어서 분석하였다. 기관별 역할은 입법부, 행정부, 사법부로 나누고 행정부는 다시 전담 부서와 강제 수단으로 나누어 검토하였으며, 사법부는 징벌적 손해배상제도와 법률의 명확성으로 구분하여 분석하였다. 학교 현장의 적용은 대상과 내용으로 나누어 분석 검토하였다. 이를 통해서 세 가지 시사점을 도출하였다. 첫째, 성립 배경으로 여성의 사회적 기회 제공과 양성평등 실현을 위한 체육학계의 활발한 연구를 통하여 학교현장에서 실질적으로 양성평등을 실현할 수 있는 법제도의 완비를 요구하는 사회적 열망이 커지고 있다는 점이다. 둘째, 기관별 역할에서 만들어진 법률을 실행할 전담기구와 법률의 실효성을 높이기 위한 강제수단의 필요성을 알게 되었다. 셋째, 학교현장의 적용에 있어 체육활동이 가장 활발히 이루어지는 초등학교 여학생을 대상으로 해야 하고, 내용으로는 여학생들이 가장 많은 체육활동을 접하게 되는 체육수업에 법이 현실적으로 적용될 수 있게 하는 것이 중요하였다. 연구 과정에서 분석된 미국의 남녀교육균등법((Title Ⅸ)의 성공요소를 바탕으로 한국에 적합하고 실효성 있는 법 제정에 도움이 될 수 있는 시사점을 제공할 수 있었다.
This study was intended to find out the causes that the existing gender equity laws could not practically contribute to sports gender equality activities by researching the Title Ⅸ that are successful case of female students’ sports revitalization in the situation that discussion on enactment of Korean style sports gender equity law for female students’ sports is actively performed. The purpose of this study was to provide implications that can be helpful for enacting practical and effective law that is suitable for Korea, based on factors of success found in Title Ⅸ. Regarding the factors of success, the background of establishment was categorized to the process of enactment laws, and the enforcement process was classified into the roles of each institution and the application of school field. The roles of each institution were divided into the legislative branch, the executive branch and the judicial branch. The executive branch was divided into responsible department and compulsory measures, and the judicial branch was divided into punitive damages and the principle of definiteness. The application in the school field was divided into object and content. As a result, three implications were found: first, regarding the background of establishment, through active research in the field of physical education on providing social opportunities and gender equality for women, there is increasing social demand for improving the legal systems that can practically ensure gender equality in school field. Second, regarding roles of institutions, it is necessary to establish a department responsible for executing relevant laws, and compulsory measures to improve effectiveness of the laws. Third, regarding application to school field, it is important to enable the law to be applied to female elementary school students as the main object, and physical education in which female students are most likely to engage in physical activities as the content. Based on Title Ⅸ, this study proposed implications that can help enact relevant laws that are suitable for Korea and have practical effects.
