Article 25 (2) of the Copyright Act stipulates that the copyright is limited to the use of the copyrighted works exploited by the school or other educational institutions or educational support institutions to support the classes in consideration of the publicity of education . This paper will discuss the category of the subject and the scope of the use of the work in relation to the use of the work for the purpose of supporting the classes provided in this section. First, in relation to the category of educational support institution , education support institutions under Article 25(2) of the Copyright Act mean those of the educational institutions which satisfy two requirements such as (i) institutions for supporting classes and (ii) institutions belonging to the state or local government In relation to the latter requirement, this regulation does not apply to the public institutions, since the institution should be a national institution or a local government institution. However, considering that public institutions perform practical business for teaching support, I think it is appropriate to include public institutions that perform tasks of teaching support in educational support organizations. Thus, the legislative purpose of adding educational support organizations to Article 25 (2) of the Copyright Act can be realized. Second, the use of copyrighted works as provided for in paragraph 2 of Article 25, which is deemed necessary for the purpose of class or teaching support, shall be limited to the minimum extent necessary. Unlike existing schools and educational institutions operated by the state etc, the use of copyrighted work exploited by the educational support organizations shall be restricted only for the purpose of teaching support . However, the copyright law does not make a difference between educational institutions or educational support organizations in terms of the category of the use of works. In other words, regardless of educational institutions or educational support organizations, both of them may reproduce, distribute, perform, display or publicly transmit part or all of the published works. Article 25 (2) of the Copyright Act, which permits the use of copyrighted works for purposes of school education, does not clearly stipulates the category of the subject and the scope of the use of the work in relation to the use of the work for the purpose of supporting the classes provided in this section. Since copyright restrictions limit copyright holders’ copyrights, it is desirable to be defined and operated as clearly as possible so that there is no room for controversy through interpretation.
