스포츠 Integrity의 유지는 스포츠경기를 공정하고 공평하게 진행하는 보장으로서 스포츠정신의 체현이기도 하다. 중국의 경우 1990년대 이후 사회주의시장경제체제의 수립에 따라 프로스포츠가 급속하게 발전하여 그 성과에 대하여 세계가 주목하고 있지만 프로스포츠의 발전과정에서 스포츠 Integrity를 침해하는 스포츠 부정부폐현상이 끊임없이 발생하여 스포츠에 대한 대중들의 신뢰에 영향주고 프로스포츠의 지속적이고 건강한 발전을 저해하고 있다. 현재 중국의 스포츠영역에서의 부정부폐는 주로 심판의 악의적인 오심, 승부조작, 선수자격위조, 도핑행위, 스포츠도박 등으로 나타난다. 중국 스포츠 부정부폐의 원인에는 중국사회의 체제전환과정에서 나타난 사회적 부폐가 프로스포츠영역에서 반영된 면도 있고 프로스포츠가 개시와 발전과정에서 법제도가 미흡함에 기인한 면도 있다고 하겠다. 따라서 이 글은 중국 프로스포츠영역의 부정부폐현상을 고찰한 기초위에서 스포츠 Integrity 보호를 위한 법규제의 현황과 존재하는 문제점에 대하여 검토한 후 향후 개선과제를 지적하였다. 현재 중국의 스포츠 Integrity를 보호하기 위한 법적 규제를 살펴본다면 “스포츠법”상 스포츠 Integrity를 보호하기 위한 법률규정이 미흡하고 법률책임이 명확하지 않으며, 도핑방지 등에 관한 행정법규와 부문규장간의 적응성이 부족하고 스포츠사회단체의 정관제정이 절차적으로 하자가 존재하며, 민사법률이 규정한 입증이 어렵고 배상액수가 낮으며, 형사책임은 엄격하지만 목표성이 떨어지는 등 문제가 존재하고 있다. 따라서 스포츠 관련 법률, 행정법규와 민사법, 형사법을 막론하고 프로스포츠 부정부폐방지에서의 역할은 많은 제한을 받고 있다. 그러므로 “스포츠법”을 개정하고 “프로스포츠조례”와 “스포츠부정경쟁방지조례”를 제정하며, 스포츠 사회단체 정관을 개선하고 “문체경기조종죄”를 증설하며, 스포츠중재제도를 수립하는 등을 통하여 중국 프로스포츠의 부정부폐방지 법적 규제체계를 개선함으로써 스포츠 Integrity에 대한 보호를 강화하여 중국 프로스포츠의 지속적이고 건강한 발전을 실현하여야 한다.
The author is convinced that the following problems exist in China s current legal regulations: inadequacy of legal provisions on protection of sport integrity and ambiguity of liabilities in Sports Law, lack of conformity between administrative regulations and departmental rules on anti-doping, flaws in the procedure for establishing the constitution of sports social groups, difficulty of obtaining evidence and low damages through civil laws and regulations, and deficiency of pertinence in criminal responsibility which is strict, though. Therefore, no matter it is sports law, administrative regulations, civil law, or criminal law, their functions in fighting against corruption of professional sports are very limited. It is necessary to amend the Sports Law, enact the Professional Sports Regulations and Regulation of Anti-unfair Sport Competition, improve the constitutions of sports social groups, add “manipulation of culture and sports competition” in criminal law and establish sports arbitration system, etc., in order to improve our anti-corruption legal system, strengthen the legal protection on sports integrity and achieve the healthy development of China’s professional sports.
