The study is aimed at drawing up a revised bill to Cycle and Motorboat Racing Act to secure legal ground for the release of online betting. Currently, the cycle and motorboat racing business operated by KSPO(Korea Sports Promotion Foundation) faces a total crisis due to over-population of OTB(off-track-betting) release places, spreading illegal gambling online, difficulties in aging customers and inflow of new customers, restricted participation in betting, and intensive regulatory policies such as total sales CAP system and electromagnetic card system in the gambling industry. To address this, resuming online betting release, which had previously been suspended due to lack of legal grounds, is considered a effective alternative. In order to draw up a revised bill, the National Sports Promotion Act(Sportstoto), Lottery and Lottery Fund Act(Lottery), the recently proposed revised bill of the Korea Racing Authority Act(Horse racing) were also analyzed in depth. The results of review on the statute related to online betting releases are as follows. First, the revised bill should include an online betting release method in the definition of the winner s betting ticket (article 2), and the release of the winner s betting ticket (article 9) so that it can be launched over the information and communication network. Second, a warning clause (article 17) should be included in the promotion and advertisement for customers when it is released online, as in the case of cycle and motor boat racing course and OTB release places. To push for effective legislation of the revised bill, it is necessary to study the positive effect of online betting releases and to develop sophisticated logic. In addition, efforts to promote and persuade the National Assembly and the public should be made at the same time.
