인공지능(Artificial Intelligence) 기술은 사회적으로 엄청난 이익과 변화를 가져올 것으로 예상된다. 예를 들어, 지능형 자율 차량은 사람의 부주의나 실수로 발생하는 사고를 줄이고 안전성을 높여주는 것으로 알려져 있다. 그리고 다양한 기계의 자동화가 실현되면 사람은 번잡한 작업에서 해방되어 시간적 여유가 생겨 더 가치 있는 일이나 취미에 시간을 투자할 수 있게 된다. 따라서 인공지능 기술은 우리 사회를 보다 편리하고 풍요롭게 하는 데 기여할 것으로 기대되고 있다. 인공지능 기술은 아직까지 약한 인공지능의 단계에 머물고 있지만 강한 인공지능으로 진화할 가능성을 매우 높고, 또한 빠르게 진행되고 있다. 따라서 논문에서는 인공지능이 가져올 민사책임에 대한 근본적인 질문, 즉 인공지능은 민사책임 이론에 어떠한 문제를 제기하며, 그 경우 민사책임은 이에 대하여 어떻게 대응할 것인지에 대한 해답을 찾아보고자 하였다. 인공지능은 학습과 추론 기술을 기반으로 스스로 사고하고 판단하며 자율성과 합리성을 토대로 인간의 생활 속에 빠르게 스며들고 있다. 이러한 정보기술과 안전기술 등의 신기술 개발은 기존의 책임법체계에서 예정하고 있던 것이 아니어서, 이에 대한 현행 제도의 패러다임 변화가 필요하다. 자율 운전 차량이 사고를 낸 경우 누가 책임을 져야 하는지, 인공지능 기술 하자로 인하여 발생한 사고의 경우 누가 책임을 져야 하는지 등의 기존에 책임원리로는 적절하게 대응 할 수 없는 상황이 발생할 수 있다. 또한 인공지능을 악용하는 인간이 사회에 해를 끼칠 위험은 다른 모든 기술과 마찬가지로 현시점에서도 충분히 주의를 기울일 필요가 있다. 따라서 이러한 문제에 대하여 성급하게 안전과 안심을 보장하는 것이 아니라, 현상을 정리하고 윤리적, 사회적, 법적 논점들을 살펴보고, 무슨 문제가 있는지 무엇을 앞으로 검토해 나갈 것인가를 여러 관점의 상호 관계성을 바탕으로 민사책임 원리를 검토하고자 한다. 책임제도와 관련하여, 인공지능에 의하여 발생한 손해의 경우 전통적인 과실책임주의가 유효하게 적용될 수 없는 문제가 제기되고 있다. 특히, 인공지능에 의해 통제되는 경우(인간의 직접적인 조작행위를 요하지 아니한 경우) 전통적인 과실책임주의를 적용하는 것은 적절하지 않은 것을 볼 수 있었다. 현재 우리의 책임법체계는 행위자의 주의의무 위반을 기초로 하는 과실 책임 체계와 위험원의 지배자(무과실책임, 엄격책임)에게 사회적 손실분담의 차원에서 부과하는 위험체계의 두 가지 책임체계를 가지고 있다. 과실 책임과 위험책임은 서로 다른 책임체계를 가지고 있으므로 오늘날 책임법체계를 양분하는 양대 지주로서의 기능을 갖고 있어야 하는 것이 바람직하지만, 책임법 특히, 손해배상의 목적은 인간의 사회생활에서 생기는 손해를 정의에 맞게 분배하는데 있다. 즉 손해로부터의 보호를 요구하는 피해자 측의 주장과 공익 실현을 위한 활동(신기술 개발 및 활용)의 자유를 요구하는 측의 주장 사이에서 합리적인 조화점을 찾아내어 누구에게 책임을 귀속시킬 것인가를 결정하는 것이 주된 임무이다. 따라서 인공지능 기술의 개발과 활용은 사회 전반에 걸친 윤리적, 법적, 사회적 측면에 큰 영향을 주고 상호 관계적인 측면이 강하기 때문에 윤리적 관계, 법적 관계, 사회적 관계를 합리적으로 조절하여 발생할 수 있는 위험에 대하여 공평 분담 할 수 있는 민사책임원리들이 필요하다.
Artificial intelligence technology is expected to bring enormous benefits and change to human society. For example, intelligent autonomous vehicles are known to reduce accidents caused by human fault. And when the automation of various machines is realized, people are freed from troublesome work and have time to spare, allowing them to invest time in more valuable work or hobbies. Therefore, artificial intelligence technology is expected to contribute to making our society more convenient and enriching. However, the development of new technologies, such as information technology and safety technologies, was not planned under the existing legal system, so a paradigm shift in the current system is needed. In the event of an accident involving an autonomous vehicle, it may be impossible to properly respond to the existing principles of responsibility, such as who should be responsible for an accident caused by a defect in artificial intelligence technology. Also, the danger that humans who abuse artificial intelligence will harm society needs to be paid close attention at this point, as with all other technologies. Therefore, instead of hastily ensuring safety and security on these issues, we study interrelationships from various perspectives on what is wrong and what will be reviewed in the future. With regard to the liability system, the problem of traditional negligence liability cannot be applied effectively in the case of damage caused by artificial intelligence is raised. In particular, it could be seen that it was not appropriate to apply traditional fault-tolerance when controlled by artificial intelligence. At present, our liability legal system has two liability systems: a fault liability system based on the violation of the actor s duty of care and a risk system imposed on the ruler of the hazard(faultless liability, strict liability) in terms of social loss sharing. Although it is desirable to have the function of two landlords who divide the liability legal system today because the liability and risk liability have different responsibility systems, the purpose of the liability law, especially the purpose of compensation for damages, is to distribute the damages incurred in human social life according to justice. In other words, the main task is to find a reasonable balance between the victim s claim for protection from damage and the one s claim for freedom of activities to realize the public interest and determine who should attribute the responsibility. Therefore, since the development and utilization of artificial intelligence technology greatly affect the ethical, legal and social aspects of society as a whole and the mutual aspects are strong, civil liability principles are needed that can be fairly shared about the risks that may arise by rationally controlling ethical, legal and social relationships.
