스포츠는 고유의 문화와 관습 등이 존재하고, 이를 바탕으로 실정법상 불법으로 인정될 수 있는 행위들이 면책되는 경우가 있다. 하지만 문제는 이러한 사고가 책임관계가 체계적으로 구축되어 있지 않은 생활체육 상황에서 발생하면 문제가 될 수 있다. 생활체육 경기 도중에 사고가 발생하여 법익의 침해가 발생했다면, 그 권리관계는 스포츠의 자치성과 실정법의 법리 적용이 충돌하면서 해결이 결코 간단하지 않기 때문이다. 생활체육 상황에서 발생하는 사고에 대한 책임 여부에 대한 판단의 기준이 필요한데, 사회적 상당성이 그 기본적 개념으로 사용되고 있다. 사회적 상당성이라 함은 어떠한 행위를 함에 있어서 사회적인 통념에 대한 판단이 요구되는 모든 행위를 범위로 포함하며, 이로 인하여 처벌되거나 관련하여 발생하는 책임이 면제됨을 인정하는 기준으로 정의할 수 있다. 학계와 법원에서는 사회적 상당성 법리를 통해 생활체육 상황에서 발생하는 사고에 대하여 면책의 범위를 제시하고 있다. 하지만, 축구 경기에서 발생한 중상해 사건에 대관하여 대법원에서 제시하고 있는 사회적 상당성 법리에 의한 면책의 개념은 위험인수법리에 기초하더라도, 평생 목척수 손상에 의한 지체장애인으로 생활해야하는 원고에게 지나치게 가혹한 판결이라고 여겨진다. 한편 골퍼의 뒤로 날아간 공이 경기보조원에게 상해를 입힌 사례에서는 스포츠의 자치성에 대한 인정 범위에 대하여 다소 명확한 기준을 제시하고 있다. 하지만 이 사례는 우리나라의 골프 경기에서 존재하는 골퍼와 경기보조원간의 사회적 계급에 대하여 법원이 상대적으로 약자인 경기보조원을 보호해 주었다는 점에서 더 큰 의의가 있다고 여겨진다.

The accident could bring a legal problem which is not easy to solve for conflict sports’ autonomy and the legal application of the actual law. With this reason, a point of reference, could judge the legal responsibility is right or not, is required, the social reasonability is used as the basic point. Social reasonability is defined as a criterion for acknowledging that any action that requires judgment on a social norm is included in the scope, and it could be used as a legal reason for the exemption from punishment or liability. The courts also have defined the exemption scope of legal responsibility in the life sports with the social reasonability. On the case of the severe injury on spinal cord that occurred in a life football game, the Supreme Court of Korea sentenced responsibility exemption for the social reasonability of sports. However the judgement seemed too harsh for the plaintiff to the defendant who acquired a physical disability due to damage of neck spinal cord. In the other hand, the Supreme Court of Korea sentenced differently on the case of the life sports golf game, golfer’s ball was heat the golf caddy’s face and she got severe in severe injury. It is also considerable significance for the court s protection against the infringement of the legal interests of the relatively weak game assistants regarding the social class between golfers and the caddy in Korea.
