A sports accident is a generic term for sports-related accidents and is not necessarily limited to accidents during sports activities. Accidental accidents that occur in opportunities related to sports activities are widely regarded as sports accidents, so it is necessary to develop the sports accident law as a legal problem unique to the sports law. In this context, it is necessary to discuss a series of events caused by COVID-19 in the category of sports accidents. Due to the COVID-19 outbreak, people around the world have experienced a daily life that they have never experienced before. The sports world is the same, and the Olympics are no exception. The history of the Olympics, in which moments of joy and emotion lead to hope, continued unchangingly at the Tokyo Olympics 2020. Although the Tokyo Olympics 2020 has come to an end, mutants of COVID-19 are still emerging, and the possibility of another fatal infectious disease still exists. Many discussions that have taken place in the context of COVID-19 must continue. Although it cannot be concluded as a fact, it is not impossible to establish a hypothetical situation for legal discussion, including various circumstances that appeared through media articles. Above all, in relation to whether the act of being infected with COVID-19 and spreading it to others can be evaluated as an act of negligence, the duty to prevent infection is derived from the positive law and sports autonomy regulations, The possibility of acknowledgment of negligence was reviewed on the premise of the existence of predictability and avoidability of infringement of legal interests. Furthermore, even if it is assumed that all the conditions for the establishment of an illegal act are met, the possibility of immunity or limitation of liability was examined from the unique point of view of a sports accident.
