스포츠사고는 스포츠와 관련하여 일어난 사고를 총칭하는 것으로 반드시 운동경기 중 사고에 한정할 것은 아니다. 스포츠활동과 관련된 기회에 발생하는 우연한 사고는 널리 스포츠사고로 보아 스포츠법 고유의 법리 문제로서 스포츠사고법을 발전시켜 갈 필요가 있다. 이와 같은 맥락에서 코로나19로 인하여 발생한 일련의 사태도 스포츠사고 범주에서 논의 필요성이 있다. 코로나19 사태로 전 세계인은 경험해 보지 못한 일상을 겪었다. 스포츠계 역시 마찬가지이고 올림픽도 예외는 아니었다. 환희와 감동의 순간이 희망으로 이어지는 올림픽의 역사는 도쿄올림픽 2020에서도 변함없이 계속되었다. 도쿄올림픽 2020은 그 대단원의 막을 내렸지만, 코로나19 변이종은 여전히 계속 출현하고 있고, 또 다른 치명적인 감염병 발생의 가능성은 상존한다. 코로나19 상황에서 이루어졌던 여러 논의는 앞으로도 계속되어야만 한다. 사실로 단정할 수는 없지만 언론 기사 등을 통하여 나타난 여러 사정을 비롯하여 법리적 논의를 위한 가상의 상황을 설정하고 코로나19로 인한 스포츠사고로서의 손해배상책임, 특히 불법행위에 기한 손해배상청구권의 인정 가능성에 대하여 생각해 보았다. 무엇보다도 그 자신이 코로나에 감염되어 다른 사람에게 이를 전파 시킨 행위를 과실 있는 가해행위로 평가할 수 있을지와 관련하여 실정법 및 스포츠자치규범으로부터 감염방지의무를 도출하고 그 의무위반 행위, 부작위의 경우라면 그 법익침해의 예견가능성과 회피가능성의 존재를 전제로 과실 인정 가능성을 검토하였다. 나아가 불법행위 성립요건을 모두 갖춘 것으로 가정하더라도 스포츠사고의 고유한 관점에서 그 책임의 면책 내지 제한 가능성에 대하여도 살펴보았다.

Above all, in relation to whether the act of being infected with COVID-19 and spreading it to others can be evaluated as an act of negligence, the duty to prevent infection is derived from the positive law and sports autonomy regulations, The possibility of acknowledgment of negligence was reviewed on the premise of the existence of predictability and avoidability of infringement of legal interests. Furthermore, even if it is assumed that all the conditions for the establishment of an illegal act are met, the possibility of immunity or limitation of liability was examined from the unique point of view of a sports accident.
