스포츠지도자는 체육지도자를 말하는 것으로 국민체육진흥법에 따르면 체육지도자에는 스포츠지도사와 건강운동관리사 장애인, 유소년, 노인스포츠지도사 등 분야별로 자격을 가진 사람을 분류하여 규정하고 있다. 그런데 3121년 제정된 스포츠기본법에는 체육지도자란 용어는 없고 스포츠지도자란 용어만 언급되어 있다. 그래서 스포츠기본법이 스포츠와 체육을 구분하고 있어서 스포츠지도자와 체육지도자도 구분해야 하는 문제가 발생할 수 있다. 스포츠지도자에 관한 현행법은 국민체육진흥법이다. 국민체육진흥법은 체육지도자라는 용어를 사용함으로써 스포츠기본법에서 사용하고 있는 지도자와 동일한 의미를 갖는지 문제가 된다. 국가의 실정법이 스포츠와 체육을 구분함으로써 스포츠지도자와 체육지도자도 구분될 수밖에 없는데, 국민체육진흥법은 용어의 관점에서 볼 때 협의의 개념인 체육지도자에 광의의 개념인 스포츠지도자 또는 자격사라는 의미에서 스포츠지도사를 포함하고 있다. 실정법상 스포츠와 체육이란 용어의 구분으로 인하여 발생하는 문제 이외에도 스포츠지도자의 자격에 관해서는 국민체육진흥법 시행령에서 스포츠지도사, 건강운동관리사 장애인스포츠지도사 등에 관하여 규정하고 있다. 그런데 국민체육진흥법상 유소년스포츠지도사와 노인스포츠지도사에 관해서는 구체적인 자격 기준을 규정하고 있지 않다. 이는 국가가 자격을 부여하는 국가자격사라는 점에서 구체적인 기준이 필요하다고 본다. 국가자격제도는 2009년 자격기본법이 제정되면서부터 기본법체계 하에 정비되기 시작하였다. 자격기본법은 국민의 생명과 재산, 국가안보 등 중요한 분야의 전문자격제도는 개별 법률에서 규율하도록 하고, 국가산업분야의 국가기술자격에 대해서는 국가기술자격법에 근거하여 개별법상 근거를 두고 주무관청에서 관리하도록 하고 있다 스포츠자격사제도도 이에 근거하여 자격제도를 규율할 수 있다. 국가자격제도의 관점에서 보면 체육지도자는 국민체육진흥법에 근거하여 동 시행령에 규정되어 있다. 그런데 체육지도자 중 건겅운동관리사는 스포츠분야보다는 보건복지분야의 자격에 해당한다고 할 수 있어서 이에 대한 정비가 필요하고, 청소년스포츠지도사와 노인스포츠지도사는 구체적 기준이 명확하지 않는 문제가 있으며, 스포츠가 체육보다 광의의 개념이란 점에서 용어의 정리가 필요하다. 스포츠가 국민의 생활에 일부가 된 현실과 생활체육의 활성화라는 관점에서 스포츠지도사는 전문체육 분야의 스포츠지도사뿐만 아니라 생활체육과 학교체육에서도 스포츠지도사 자격을 법률로 명확하게 규정하여 국가자격으로서 스포츠지도사를 규율하는 것이 필요하다. 그래서 스포츠기본법에 근거를 두고 스포츠지도사 자격에 관한 특벌법을 제정하거나, 아니면 국민체육진흥법을 개정하여 법률상 근거를 명확하게 정비해야 한다.
