일반적으로 국가보훈은 국가의 존립과 안전을 위한 희생과 공헌에 대하여 보상과 예우를 행하는 것으로서 이것을 사회의 공감대로 하여 국민의 애국정신 함양과 국가의 정체성 확립의 계기로 삼고 다시금 국가공동체의 유지 발전의 기반으로서 기능을 수행할 수 있도록 한다는 점에서 제도적 의의가 있다. 그러나 대한민국 상이1급 국가유공자의 보상제도의 현황은 이러한 국가보훈제도의 의의에 부합하지 못하고 있어 우려되는 바가 매우 크다고 할 수 있다. 현재 상이1급 국가유공자의 수는 전체 전·공상군경 국가유공자의 1.75%에 해당되는 비교적 소수의 그룹이다. 이들 중 신체절단으로 인한 상이1급 판정받은 경우가 가장 많은 26%를 차지하고 있고, 다음으로 척수장애가 24%, 양안실명이 22%, 정신장애가 13%이며 그밖에 복합적 사유로 인한 상이1급 판정을 받은 경우가 15%에 해당되고 있다. 상이1급 중상이자들의 삶의 특수성을 살펴볼 때, 현행 경상이자 위주의 무원칙적, 비합리적 전·공상군경 상이보상체계를 최소한 형평성에 어긋나지 않는 정비례형의 증가율을 갖춘 보상체계로라도 시급히 전환해야 할 것이다. 무엇보다 상이1급 국가유공자의 보상이 산업재해로 인한 장애1급을 판정받은 자의 보상과 비교해 현저하게 낮은 현실은 시급히 시정해야 할 문제가 아닐 수 없다. 또한 ‘상이1급 중상이자’들에게는 그림의 떡이나 다름없는 부수적인 교육지원, 취업지원과 같은 사회적 보호 혜택을 실질적으로 그들에게 도움이 되는 지원으로 바꾸어야 할 것이다.
This research is dedicated for better understanding of the current compensation system for strictly disabled Patriots and Veterans. Typically Patriots & Veterans Affairs are conducting various government compensation for their kindness and contribution and dedication to save the country. On this basis be enhanced patriotic spirit and national identity, and in this we find the value of Patriots & Veterans Affairs as a social institut. However, the status of the compensation for the first class of strictly disabled Patriots & Veterans of Republic of Korea is not corresponds with the value of Patriots & Veterans Affairs and it is a one of actual problems in Korean society. Currently, the group of the first class of strictly disabled Patriots & Veterans introduce to a relatively small group. Of these, 26% is the case seriously, injured arm or leg and other body parts, diseases of the spine cord by 24%, bilateral blindness by 22%, mental disorders by 13%, and other complex reasons by15%. If we consider a feature of life of the first class of strictly disabled Patriots & Veterans, we can agree with the opinion that these existing laws on compensation for them are irrational and do not really help them. Especially we could not understand how it is possible, which the compensation for the first class of strictly disabled Patriots & Veterans is lower than for workers\' compensation as a social welfare. In addition, various additional supports for Patriots & Veterans on educations, on tours, on sanatoriums and on discounts for cultual life are all unusable to the first class of strictly disabled Patriots & Veteran, so its should be changed so that they can actually use.
