올해는 광복 60주년과 6 · 25전쟁 55주년을 맞이하게 된 우리의 역사에서 뜻 깊은 한해이기도 하다. 국가의 보훈정책이 1960년대 초기 원호관련법의 제정을 출발로 역사의 진행과 더불어 독립유공자와 국가유공자 외에 국가를 위해 희생 · 헌신한 분들을 지원하기 위하여 개별법의 제정을 통하여 산발적으로 집행되어 왔다. 때문에 일관성 있는 법체계 속에서 정책화되지 못하고 정치적 의도에 따라 보훈정책이 집행되어 왔기 때문에 대상자간의 많은 갈등과 오해를 낳기도 했음을 부인할 수 없다. 때문에 「국가보훈기본법」 은 조금 더 일찍 마련되었어야 할 과제 이었다. 그 동안 보훈 대상이 지속적으로 확대되는 등 보훈행정의 업무가 양적, 질적으로 증가함에 따라 국가보훈의 일관성 있는 원칙을 정립할 필요가 있었음도 인정되어 진다. 따라서 동 법은 현재 대상별로 개별법에 의하여 수행되고 있는 보훈정책을 일관성있게 추진하기 위하여 총괄적이고 종합적인 미래지향적인 기본법을 마련함으로써 보훈의 목적 및 기본이념을 명확히 하고 국가보훈발전기본계획과 그 추진체계를 정비하여 일관성 있게 적용하며 보훈문화의 확산 등을 통하여 국민통합과 국가발전에 이바지하려는데 그 목적이 있다. 본 연구에서는 동 법에 대한 내용을 검토하고 이에 대한 문제점과 보완적 견해를 제기해 보고자하는 것이다. 다만 이러한 기본법이 상징적인 법으로 형식주의화되지 않고 실질적으로 가동될 수 있도록 국민 모두가 관심을 기울여야 하리라고 본다. 이제 국가보훈의 문제는 우리 국민 전체의 관심사가 되어야하며(동법 제6조: 국민의 책무), 보훈문화의 확산은 조국에 대한 소속감, 충성심 그리고 애국심 함양은 물론 최근 우리의 시대적 관심사가 되고 있는 지역, 집단갈등을 해소하고 국민화합을 이룩할 수 있는 초석이 될 수도 있다는 것이다.
The Basic Act on National Patriots and Veterans Affairs(BANPVA) passed in the National Assembly has laid the cornerstone for future-oriented National Merit Reward System. And the National Merit Reward Commission will be organized to formulate National Merit Reward Policies. The BANPVA focuses on honoring the noble spirit of National Meritorious Persons as well as providing benefits for their contributions. The BANPVA. a comprehensive legislation on National Merit Reward system has been passed in the 253th plenary session of the National Assembly held on 3rd May. 2005. It is all the more significant that the BANPVA was passed in the year that marks the 60th Anniversary of National Liberation and the 55th Anniversary of the outbreak of the Korean War. Thus far. Government has had to enact legislations on individual recipients of National Merit Reward as social and political situations changed and different classes of people were included as the Recipients of National Merit Reward. The previous policy caused confusion regarding the ideas and principles of the National Merit Reward. and was criticized for having an inefficient implementation system. Moreover, the BANPVA put priority on assisting and managing the benefit recipients, as some worried, overshadowed the importance of educating the next generation and making sure they understand the lofty sacrifices and contributions people had made. The BANPVA consists of 4 chapters and 30 articles, and include these main points. The purpose of this Basic Act is to honor the noble spirit of those who had made distinguished service and contribution to the state with the ultimate goal of national solidarity and development. So, I am going to search and analysis the problem and to suggest a desirable plan on the BANPVA
