개인의 성은 자신의 인격의 표현이며, 가정과 사회질서와 밀접한 관계가 있다. 인간은 누구나 개인의 행복추구권과 자기운명결정권을 선택할 개인의 자율성과 존엄성을 지닌 인권으로서 성적자기결정권이 주어진다. 그러나 성적자기결정권에 아무런 기준 없이 성행동, 성관계가 가능하다면 개인과 사회에 해악을 끼치는 성적행위는 가정 붕괴와 사회 무질서의 혼란을 야기할 수 있다. 여성계의 반성폭력운동에서 ‘성폭력은 성적자기결정권의 침해’라고 규정을 지으면서 성적자기결정권의 용어가 화두로 시작되어 법조계에서 성문제의 판결을 위해 인용하는 용어가 되었다. 소유적 개인주의의 근간을 이루는 자유주의 철학적 사유는 성적자기결정권에 그대로 적용되어 개인의 신체와 재능은 철저하게 사회와 단절된 상태에서 개인이 선택한 다양한 성관계, 성행동은 개인의 자유에 의해 이루어진다는 합리성으로 시민들에게 확대적용 되고 있다. 이 논문은 우리사회에서 성적자기결정권과 관련되어 야기되는 다양한 성적 문제들을 해결하기 위해 통일사상적 시각에서 존재의 보편적 법칙을 근거로 기존의 성적자기결정권의 의미들을 분석하고 그의 한계를 살펴보면서 성적자기결정권의 보편적이고 객관적인 기준을 제안하려한다. 이 논문은 제안된 성적자기결정권의 기준에 따라 건전한 성의식과 성태도를 함양함으로써 긍정적이고 건전한 성행동이 우리사회에 정착하여 성적 일탈을 예방하려는 목적이 있다.
Individual sexuality is the expression of one’s own character, and is connected with the order of the family and society. Without universal and objective standards, deviate sexual intercourse and behavior cause broken families and disorder in society. The purpose of this paper is to solve the various sexual problems connected with individual decisions about sexuality through establishing a basis for sexual solutions in our society. This paper also introduces the universal principles of sexual norms and suggests reconstructing the meaning of individual decisions about sexuality based on the universal principles of sexual norms. Especially, this paper inquires into what problems are related to individual decisions about sexuality from the viewpoint of the standards of sexual norms. Let us understand the fact that sexual intercourse ignoring the sexual norms based on the universal principles creates sexual deviations, broken families and disorder in society. Moreover, this paper intends to protect against sexual deviation and establish healthy and optimistic sexual consciousness and attitudes according to the universal standards of individual decisions about sexuality.
