Behaviors that infringe life or body during playing sports has rarely been a problem in criminal law. An important reason why they are not a problem in criminal law is because they are solved in self-governing sports regulations. However, since significant violations of regulations or deliberate bodily infringements cannot be justified, it is possible to apply criminal law to the cases. Injuries occurring although parties of cases strictly followed game rules or minor violation of regulations which are expected to happen considering the characteristics of each game can be justified. All bodily infringements beyond such limitations satisfies components as crimes. Of course, in these cases, intentions to violate the benefit and protection of the law have to be recognized, and it is not enough to recognize them only as game rules. It is only a problem of fault if the injury does not occurred deliberately although there have been recognition on breaching game rules. With such conditions as premises, it is not adequate that the basis that injuries and deaths occurring during playing sports are justified is not included in the crime composition requirements given the function of warnings of crime composition requirement. In other words, removal of illegality is reasonable when the fact that required ideas and justified ground have to be considered is beared in mind since the behaviors of those who cause injuries and assaults in others satisfies crime composition requirements. The basis becomes consent of victim if illegality removal is justified. Article 24 of Criminal Law regulates consent of victim as a reason for removal of illegality.
