이 논문은 1991. 12. 31. 제정된 「경륜·경정법」에 터 잡아 올해로 21년째를 맞는 경륜사업의실태와 문제점을 살펴보고, 동법의 개정방향을 제안하는데 그 목적을 두고 있다. 물론 그 기저에는경륜사업이 추구하는 레저스포츠로서의 성격을 강화하여 그 건전성을 회복한다는데 초점이 맞춰져있다. 이 점에서 본 논문은 선행연구들에 비하여 차별성을 인정받을 수 있을 것이다. 사행산업의 일종인 경륜은 ‘도박성’과 ‘레저성’을 겸유하고 있으므로 그 규제 범위를 정함에 있어 다양한 논란과 혼선이 있었다. 특히 그 수익금의 공익적 기여도가 적지 않아 규제론의 정당성이 크게 왜곡되어 온 측면이 있다. 경륜 등 스포츠를 매개로 하는 사행산업은 건전성이 담보되지않으면 사업 본래의 목적이나 근거법률의 입법의 취지를 구현할 수 없게 된다. 경륜의 사행성이 심화될수록 도박중독으로 인한 각종 질병의 증가, 가족의 해제, 노동의욕의 상실, 파생 범죄의 증가 등 심각한 사회경제적 문제를 유발시킨다. 필자는 경륜의 공익성을 유지하면서도 베팅참가자의 도박몰입도와 도박유병율을 최소화할 수 있는 제도적 방안을 모색하는데 주력하였다. 이러한 관점에서 도박중독을 유인하는 장외발매장의 설치는 매우 엄격한 요건 아래서 허가되어야 하고, 이미 그 실효성을 상실한 베팅상한제는 전자카드제도의 전면적 도입을 통해 규제되어야 할 필요가 있다.
The purpose of this paper is to analyze the actual situation and problems of the bicycleracing business based on「BICYCLE AND MOTORBOAT RACING ACT, enacted 12/31/1991」and to propose a Direction of Reforms in the same Law. This paper is also focused onrestoring integrity by enhancing the nature of the bicycle racing business as a leisure sport. In this respect, this paper could be recognized originality compared to previous studies. There was a variety of controversies and confusions to limit regulation object of the bicycleracing business since it has the characteristic of gambling and leisure as a sort ofmeandering business. In particular regulation on this business is greatly distorted in terms ofpublic contribution of proceeds from the business. If the meandering business through thesports such as bicycle racing could not guarantee the soundness, it will not be able toimplement the purpose of the original business or legal basis. As the bicycle racing business has raised speculation, gambling addiction causes significantsocial and economic problems such as the increase of various diseases, family breakdown, workdemotivation, increase of derived crime. This paper has focused on finding the institutionalmeasures to minimize betting involvement and the prevalence rate of gambling whilemaintaining the public interest in the bicycle racing business. In this respect, the installationof the OTC Dealer causing gambling addiction should be allowed under the strictrequirements and invalid Betting Ceiling System will need to be regulated through a full-scaleintroduction of the e-card system.
