양대 체육단체인 사단법인 대한체육회와 (사) 국민생활체육회가 통합을 위한 과정에 있다. 양대체육회의 통합과 관련하여 다양한 부분에서 신중히 검토되어야 할 점이 많다. 특히 법제도의 오해나 필요한 입법이 불완전하여 어렵게 합의되어 진행되고 있는 양대 체육단체의 통합이 저해되는것을 막아야 한다. 이하에서는 그러한 법적 검토중에서도 통합체육회의 설립을 위한 등기절차상의과제에 대해서 주로 검토하도록 한다. 통합체육회의 등기절차에 필요한 관련법규를 검토한 결과 다음과 같은 사실을 확인하였다: 대한체육회와 국민생활체육회의 통합은 신설통합의 방법을 취하고 있다는 점, 통합체육회의 설립등기가 완료되면 대한체육회와 국민생활체육회는 양 단체의 대의원 총회를 거치지 않고 해산된다는 점. 여기서 해산이란 별도의 청산절차 없이 그 사유의 발생만으로 법인격이 소멸하는 것이된다는 점이다. 통합시·도체육회는 통합체육회의 지부이며 법인의 형태로 존재할 수 있음을 국민생활체육진흥법에 명문으로 규율하는 것이 바람직하다. (사)국민생활체육회의 해산근거는 국민체육진흥법에만 규율되어 있다. 이는 문제의 소지가 있으므로 (사)국민생활체육회의 근거법률인 생활체육진흥법 부칙에 해산에 대해서 규율하는 것이 필요하다. 앞으로 남은 양대 체육회의 통합이 법적 하자 없이 원만히 이루어져 국민체육의 새로운 지평을개척해 줄 것으로 기대한다.
The two major sports organizations in Korea, ‘Korean Olympic Committee’ and ‘Council of Sport for All’ are in the process for integration. After the process for integration, so-called ‘United Sports Body’ should begin its existence. With regard to the integration of these sports organizations many things have to be considered carefully in various parts. First of all, it should be prevented that in particular due to a misunderstanding of the legal system or due to an incomplete legislation the Integration is disturbed. Among the legal reviews we should look deeper into the Registration Procedure for Incorporation of United Sports Body. Such Reviews lead us to the following conclusion: The method of integration with Korean Olympic Committee and Council of Sport for All is newly-integration. And then, if the United Sports Body have completed the registration of incorporation, Korean Olympic Committee and Council of Sport for All are would dissolved without two organizations general meeting of representative. The dissolution means here is that, the corporate entity will be cessated without a separate liquidation-procedure. It is desirable to regulated a substantive enactment in National Sports Promotion Act that, the cities and provinces‘ athletic association is chapter of United Sports Body and it could exists in corporate forms. And the grounds for dissolution of Council of Sport for All is only regulated in National Sports Promotion Act. But it could causes problems. Therefore, we need regulation about the dissolution on supplementary provisions of Sports for all promotion Act , which is basis law of Council of Sports for All . Look forward to shaping up well process about the two major sports organizations integration, and opening a new horizon to national sports.
