선수를 위한 대리제도가 한국의 프로시장에서는 원활하지 아니하다. 프로선수가 자신의 기량을극대화하고 이러한 능력을 경쟁시장에서 프로야구에서는 선수계약시에 선수대면계약만을 고집해왔다. 최근 일명 선수대리인제도의 도입으로 대리에 의한 계약이 허용되고는 있으나 아직까지 구체적인 시행시기를 합의하지 못하고 있다. 프로농구는 한국농구연맹 구약에 따라 에이전트 근거규정은 있으나 에이전트 등록절차가 마련되지 않아 이 규정이 적용할 제도의 시행이 어렵다. 프로배구는 한국배구연맹 규약 제70조 제2항에서 대면계약을 원칙으로 하고, 구단에서도 선수대리인제도를인정하지 아니한다. 프로야구, 농구와 배구에 비하여 프로축구는 선수대리인제도도 허용이 되고 이것이 이미 시행되고 있다. FIFA 에이전트 규정을 통하여 공식 에이전트를 인정하였다가 지난 2015 년 4월에 등록 중개인제도로 새로운 시스템의 선수에이전트 제도가 도입되었으나 향후 전개 상황에 대하여 낙관하기는 어렵다. 이러한 현상은 미국과 비교되는 것이다. 프로스포츠 리그가 선수노조를 인정하고 에이전트활동을 허용함으로써 선수의 권익이 높아지고 선수의 다양한 가치를 발굴하고 이를 교환할 수 있는 경제시장이 형성되는 것이다. 사실상 프로선수의 신체는 그 자체가 상품이다. 고도로 훈련된 기량인 기술을 더하여 신체적 활동가치를 발전시킴으로써 프로선수의 가치가 여러 각도에서 높아진다. 이러한 기초적인 시장 상황을 분석하고 다양한 협상기법 등을 통하여 이를 경제적 가치로 제고하는 것이 경쟁시장에서의 가치창출이다. 이러한 일련의 과정을 프로선수가 직접 나서는 것보다는 전문관리인 등의 위임관계를이용하여 이를 전문적으로 접근하면 프로선수의 경제적 가치 및 법적인 가치 등이 훨씬 더 보호될여지가 많다. 우리나라에서는 프로스포츠 종목마다 드래프트제, 자유선발제 또는 트레이드제와 같은 다양한방식의 선수선발과 연봉체계를 가지고 있는데 이것이 스포츠활동을 직업으로 삼는 프로선수의 노동법적 가치 및 경제법적 가치에 부합하는 것인지 확인해 볼 필요가 있다. 또한 이적제도에서 선수계약에 대한 구속력을 확인하여 선수의 법적인 가치를 인식할 필요도 있다. 스포츠활동을 바탕으로 한 스포츠재로서의 가치를 경제적으로 높이기 위하여 선수대리제도를 개선하여 프로선수의법적인 지위를 제고하여야 할 것이다.
