지방재정의 어려움이 심화됨에 따라 지방재정 확충을 위한 방안으로 체육진흥투표권의 발매액에 지방세인 레저세를 부과하기 위한 논의가 계속되어 왔다. 레저세를 도입하게 될 경우에는 지방재정의 확충이라는 목표는 달성할 수 있는 반면 체육재정의 감소라는 결과도 가져오게 되기 때문에 필연적으로 이를 둘러싼 갈등이 발생할 수밖에 없다. 실제로도 체육진흥투표권에 대한 레저세부과를 위한 입법 추진과정에서 지방자치단체와 체육단체 사이에 상당한 수준의 사회적 갈등을 겪은 바 있고, 그러한 갈등은 여전히 현재진행형이기도 하다. 이러한 갈등에 대한 해결방안을 마련하고 이를 법제화된 형태로 제시할 수 있는 것도 법학과 정책학, 그리고 법정책학의 사명이라 할 수있을 것이다. 본고에서는 체육진흥투표권에 대한 레저세 도입과 관련된 갈등에 대한 해결방안을제시해 보았다. 첫째로 레저세를 도입할 필요성과 명분은 충분히 인정되기 때문에 원칙적으로 도입을 하되, 체육재원의 급감이 발생하지 않도록 점진적으로 도입하는 것이다. 이를 위해서는 체육진흥투표권의 총매출액 증가 추세에 맞추어 탄력세율제를 적극적으로 활용하는 방안을 제안하였다. 둘째로, 레저세를 도입하더라도 체육재원이 감소하지 않도록 하기 위하여 현재 불법적으로 이루어지고 있는 각종 스포츠 도박사이트 등에 대한 수요를 체육진흥투표권에 대한 수요로 이전시키는 방안을 강구하는 것이다. 이를 위해서는 불법적 스포츠 도박을 합법적인 제도권 내의 체육진흥투표권으로 양성화하는 방안을 모색하여야 할 것이다. 레저세를 도입하기 위한 명분과 필요성이 인정된다고 하더라도 이를 일방적으로 추진할 경우에는 성공하기 어렵고 무엇보다도 사회적 갈등과 비용을 초래하게 된다. 특히 국민 복지에 중요한역할을 감당하고 있는 체육재원에 대한 대책 없이 추진되어서는 안 될 것이다. 지방자치단체는 체육재정의 축소 문제를 함께 고민하고 그 해결방안을 모색하여야 할 것이고, 체육계 역시 ‘레저세는단 한 푼도 안 된다’는 인식에서 벗어나 보다 전향적인 자세로 전체적인 체육재원의 확대 방안을고민할 필요가 있을 것이다
This study is aimed to find a resolution from legal and political aspects to reconcile social conflict caused by legislative attempts to impose leisure tax on the sports toto. To enhance financial stability of local government, the bill which was purposed to introduce leisure tax on sports toto has been submitted three times since 2010. That taxation could cause reduction of sports budget nationally, disagreement and conflict is bound to occur on that issue. The legal and political approach is needed to reconcile these social conflicts. And measure to resolve these social problems also is based on legislation. I proposed some measures as resolution to solve social problems. First, the introduction of leisure tax on sports toto is needed in aspects of tax equity and internalization of external costs. But it should be introduced not radically but gradually. Total amount of sports budget should be maintained for some years. Next, to accrete the sum total of sports toto incomes, prohibiting unlawful sports gambling and taking up excessive demand on unlawful sports gambling to lawful sports toto can be a resolution. Although justification and necessity of taxation is recognized, arbitrary attempts without mutual and social content is hard to succeed and inevitably will lead to social conflicts and costs. In particular, there should be consideration on sports fund, which plays significant role for public welfare. And also those who are in the sporting circles are needed to take a proactive stance to deliberate on the leisure tax legislation. To solve such a social problem, a combinational system of legislation is needed. That can be called as juridification of sports. To find the measure of reconcile social conflicts by legal measure is a mission of law and jurists.
