최근 전문체육시설이나 국민체육시설이 들어서고 이를 이용하는 인구수가 증가하고 있는 현실의 상황은 매우 긍정적이다. 공중이 모이는 장소는 다중시설 참여자 스스로가 질서를 지키려는 노력이 필요한 것이 사실이지만, 그 보다 앞서서 시설물의 안전이 우선 담보되어야 한다. 체육시설의 안전과 관련해서 토목공사 등에 대한 기준이 보수적인 독일에서는 여러 가지 법적근거를 마련하고 있다. 독일에서 스포츠안전과 관련한 법규는 경기장과 같은 시설물기준에 관련한측면에서도 그 대상이 되지만, 사실상 그 기원은 경기장 내에서의 과격행동을 억지하기 위한 것에서 비롯된다고 한다. 그러므로 경기장 내에서의 공중의 행동양식을 감안하여 시설물의 기준을 마련하고 있다. 우선 ‘스포츠와 안전 국가계획(Nationales Konzept Sport und Sicherheit)’이라는 프로그램을 기초로 체육시설의 안전기준이 제시되고 있다. 이 국가계획에는 스포츠행위 등으로 인한 안전사고의 예방 또는 대처 등뿐만 아니라 스포츠시설의 건축상 안전 등도 포함되어 있다. 이 계획을기반으로 구체적으로는 모델건축법과 그 시행령 그리고 건축법 및 그 시행령을 통하여 각주의 형편과 수준에 맞게 체육시설에 대한 건축기준을 가지고 있다. 또한 독일축구연맹(Deutscher Fußball Bund; DFB)과 독일분데스리가(Deutsche Fußball Liga, DFL) 역시 체육시설에 관한 지침을 만들어놓고있다. 그 외에도 산업계에서는 체육시설의 건축 및 운영과 관련된 DIN 표준규정을 활용하고 있으며 이를 기준으로 보험요율이 산정되기도 한다. 이러한 규범을 기반으로 체육시설업자나 시설의점유자가 시설로 인한 배상책임을 부보하는 보험인 배상책임보험을 다양하게 활용하는 것에서 현실적인 시사점을 찾아야 할 것이다. 우리나라의 경우 체육시설에 관한 규범으로서 체육시설의 설치․이용에 관한 법률이 존재하기는 하지만, 여기에는 구체적인 안전기준을 제시하고 있지는 아니하다. 동법 제26조에 체육시설의안전과 관련하여 체육시설업자에게 보험가입의무를 부과하고 있는 것은 그나마 다행이다. 현재 진행 중인 통합체육회의 설립에서 체육시설의 안전과 관련한 관리 등의 문제를 구체적으로 다룰 입법적 근거가 마련되기를 기대한다.
