통상 경기결과의 불확정성을 위협하는 행위인 도핑이나 승부조작에서 스포츠 integrity의 확보가 논해지지만, 이는 그 외에 스포츠관여자의 非行이나 부정부패(不正腐敗)를 포함하기도 한다. 호주 스포츠 위원회(Australian Sports Commission)는 도핑, 승부조작 뿐만아니라 왕따(bullying), 괴롭힘(harassment), 차별(discrimination), 아동학대(child abuse) 등 반사회적인 행동 모두를 스포츠의 integrity를 침해하는 것으로 폭넓게 보고 있다. 한국은 World Anti-Doping Agency(WADA)-Code(세계도핑방지규약)을 수용한 Korea Anti-Doping Agency(KADA)를 설립하여 doping에 대응하고 있다. 그리고 문화체육관광부에 스포츠공정위원회를 두어 공정성 관리 총괄 기관의 역할을 수행하도록 하다가 대한체육회로 이관하였다. 최근에는 KADA를 스포츠공정위원회의 이름으로 확대개편하여 도핑 뿐 아니라 승부조작·심판오심·(성)폭력 등 스포츠 현장에서 발생할 수 있는 반윤리적 행위에 관한 총괄 업무를 맡도록 하는 법률안이 국회에서 발의되어 논의되고 있다. 불법스포츠도박과 연계되어 있는 승부조작 사례가 세계 도처에서 발생하고 있다. 도박으로 인해 스포츠의 integrity가 흔들리고 있음에도 이 분야에는 세계반도핑기구와 같은 국제조직이 존재하지 않는다. 국제올림픽위원회(IOC)는 Olympic Agenda 2020에서 IOC 궁극의 목표가 깨끗한 운동선수의 보호에 있음을 밝히고(Recommendation 15), 이를 위해 2000만 달러를 추가로 스포츠 integrity 분야에 투입할 것을 예정하고 있다(Recommendation 16). 도박에 따른 스포츠 integrity 훼손에 적극적으로 대처할 세계반도핑기구와 같은 커다란 국제연맹을 설립하는 것이 그 논리적 귀결일 것으로 보인다. 따라서 아시아에서 먼저 선도적으로 동아시아 불법도박방지기구를 설치하여 예방교육과 강력한 제재를 가해서 스포츠인테그리티 확보에 주도적으로 나설 것을 제안한다. 그리고 요즘 스포츠에서 인종차별적 행위를 하는 제노포비아(xenophobia)도 문제된다. 헤이트스피치나 헤이트크라임도 이에 해당한다. 독일에서 시행하는 ‘스포츠를 통한 사회통합(Integration durch Sport)’에도 주목할 필요가 있다. 스포츠는 사회응집성을 높이며 서로 다른 문화를 가진 사람의 통합을 촉진하고 상호간의 이해를 증진시켜 주는 보편적인 역할을 수행한다는 점에서 효과적인 사회통합 수단이 될 수 있다. 나아가 ‘스포츠의 자율성(Autonomy)’ 확보도 스포츠의 신뢰성과 integrity를 유지하는 요소의 하나이다. 특히 정부간섭으로부터 벗어나 스포츠의 건전한 발전이 이루어지도록 재정적 독립을 가져오는 제도 개선이 이루어져야 한다. 스포츠 정신을 살리고 스포츠 integrity를 확보하기 위해서는 무엇보다도 유소년 시기부터 스포츠 윤리에 대한 체계적인 교육을 접할 수 있도록 하는 것도 필요하다. guilt culture 가 아닌 shame culture의 전통적 토양에 기반한 동아시아에서는 높은 윤리의식과 교육수준을 갖추고 있음에도 법의식은 상대적으로 부족하다. 스포츠에서의 integrity를 학보할 수 있도록 주도적으로 공통의 가이드라인을 만들고 교육에 앞장서서 앞으로의 메가스포츠이벤트를 깨끗한 스포츠로 마무리함으로써 세계스포츠에서의 동아시아 위상을 높이고 나아가 사회적 발전도 기할 수 있기를 희망해 본다.
In general, the integrity of sports is discussed as a means of ensuring integrity in doping or match-fixing which threatens the uncertainty of the outcome of the game, but it may also include the misconduct or corruption of sportsmen. The Australian Sports Commission has extensively viewed not only doping or match-fixing but also all other anti-social behavior, such as bullying, harassment, discrimination, and child abuse, as violating integrity of sports. Korea has established Korea Anti-Doping Agency (KADA) which accepted the World Anti-Doping Agency (WADA) Code to counteract doping. In addition, Sports Fair Committee was established in the Ministry of Culture, Sports and Tourism in order to carry out the role of the overall fairness management organization, which was then moved to Korean Olympic Committee. Recently, KADA has been reorganized under the name of the Sports Fair Committee, and a bill has been proposed and is being discussed by the National Assembly to undertake general affairs regarding anti-ethical acts that may occur in the sports scene, such as match-fixing, refereeing, and (sexual) violence. There are number of match-fixing cases linked to illegal sports gambling occurring all over the world. Even though gambling shakes the integrity of the sports, there is no international organization such as the World Anti-Doping Organization in this field. International Olympic Committee (IOC) announced at the Olympic Agenda 2020 that the ultimate goal of IOC is to protect clean athletes (Recommendation 15) and to commit additional $20million to the field of sports integrity (Recommendation 16). A logical consequence seems to be establishing a large international federation like the World Anti-Doping Organization which will actively deal with the deterioration of sport integrity resulting from gambling. Therefore, it is suggested that Asia take an initiative action on establishing the East Asia Anti-Gambling Organization, leading preventive education and strong sanctions to lead the securing of sports integrity. And these days, there is a problem with xenophobia. Hate speech or hate crimes also correspond to this. It is necessary to pay attention to integration through sports (Integration durch Sport) in Germany. Sport can be an effective means of social integration in that it enhances social cohesion, promotes integration of people of different cultures, and plays a universal role in mutual understanding. Furthermore, protecting the autonomy of sports is one of the factors that maintains the reliability and integrity of sports. Particularly out of government interference, institutional improvements with financial independence should be made so that healthy development of sports can achieved. To maintain sportsmanship and ensure the integrity of sports, it is also necessary to encounter systematic education on sports ethics from childhood. East Asia, which is based on the traditional soil of shame culture rather than guilt culture, has a high ethical consciousness and educational level but the legal sense is relatively insufficient. We hope to be able to raise the status of East Asia in world sports and promote social development by making a common guideline and leading the education for securing the integrity in sports to finish the mega sports event in the future as clean sports.
