축구산업은 자금을 떠나 발전할 수 없지만, 산업발전의 자금조달 수요와 공정거래환경간의 이해충돌은 중요한 법적 과제이다. 본문은 중국 회사법에 기초하여 축구FC의 지분소유제한에 관한 규정과 중국축구협회에서 새로이 제정하고 공시한 「FC양도규정」 에 관한 규제충돌을 둘러싸고, 축구산업에서의 자금조달 수요와 공정한 경기환경 조성간의 형평 및 이에 기초한 입법의 바람직한 방향을 제시하는 방향으로 논의를 진행하고자 한다.
The development of football industry is inseparable from the capital driven. The coordination between the club financing and the fair competition is the most difficult problem in food industry. For the sake of fair competition, financing is not in line with the trend of the times. Based on the provisions of the Chinese company law, this paper analyzes the problem of cross shareholding in the club and the limitation of the shareholding, in order to put forward some suggestions on how to solve the problem.
