미투운동이 국제적으로 확산되고 있는 가운데 문화예술계를 비롯하여 체육계에 이르기까지 성폭력 사실에 관한 증언 및 폭로가 광범위하게 이루어지고 있다. 특히 최근 체육계에서 운동 지도자가 미성년자인 선수를 성폭행한 사건, 운동코치가 국가대표 선수에 대하여 상습적으로 성폭행한 사건 등이 보도되면서 사회적으로 큰 파장을 불러일으켰다. 성범죄는 인권침해의 성향이 강하므로 피해자에게 큰 고통을 주며, 피해자가 자신의 피해사실을 외부에 알리는 것을 꺼리기 때문에 암수범죄가 많다. 체육계에서 발생하는 폭력･성폭력의 대부분은 가해자에게 상당한 권력이 있고 피해자는 가해자의 지도･감독에 따를 수밖에 없는 입장이기 때문에 피해자의 의사에 반하여 행해짐에도 불구하고 적극적인 거부 의사를 밝힐 수 없게 된다. 이와 같은 경우 업무상위력 등에 의한 간음죄의 성립이 부정되어 가해자에 대한 적절한 처벌과 피해자 보호･지원이 이루어지지 못한다는 문제가 발생하게 된다. 이에 본고에서는 체육계 성폭력 근절 대책을 강구하기 위하여 체육계 성폭력 실태를 파악하고, 대처상의 문제 및 해결방안에 대해 논하였다. 특히 체육계 성폭력 처벌상의 흠결을 메울 수 있도록 성범죄 구성요건의 재검토에 초점을 맞추었다.
While the ‘Me Too’ movement spread internationally, testimony and disclosure are widely made on the facts of sexual violence in the world of sports as well as the world of culture and art. Especially, the recent reports on a case in which an athletic leader sexually assaulted a minor athlete in the world of sports and a case in which a sports coach sexually assaulted a member of the national team habitually have a great impact on the society. Since a sex offense has a strong tendency of the violation of human rights, it gives much pain to victims, and the victims are reluctant to let the others know the fact of their damage, so there are a lot of hidden crimes. Especially, in most of the violence and sexual violence occurring in the world of sports, the assailant has considerable power, and victims cannot but follow the assailant’s instruction and supervision, so despite the offense is done against the victims’ intent, they cannot express active intention to refuse that. In this case, the establishment of adultery by abuse of occupational authority is denied, so there is a problem that neither proper punishment of the assailant nor the protection and support of the victim are made. Thus, this study assessed the present status of sexual violence in the world of sports to seek a measure for eradicating sexual violence in the world of sports and discussed problems and solutions in coping with that. Especially, this study focused on the re-examination of the components of a sex offense to fill the deficit of punishment on sexual violence in the world of sports.
