본 연구의 목적은 선진화된 체육시스템을 구축하기 위하여 체육단체 역량강화를 위한 법･정책 개선방안을 강구함으로써 미래지향적인 스포츠 환경 기반 조성에 도움을 줄 수 있는 자료를 제공하는 데에 있다. 본 연구를 통하여 우리나라 체육정책과 법제를 재조명하고 이에 대한 정비방안을 도출한 결과는 다음과 같다. 첫째, 우리나라 체육정책들은 대부분 구조적이고 환경적인 문제에 관심이 집중되어있고, 이를 실현하기 위한 체육단체 역량강화에 대해서는 다소 관심이 부족한 것으로 분석되고 있다. 둘째, 국민체육진흥법은 체육을 할 수 있는 환경 조성을 위한 구조 기능성 위주로 규정되어 있는 반면에 조직운영측면에서의 체육단체 역량강화를 위한 근거조항은 부실한 것으로 나타났다. 셋째, 체육시스템의 선진화 구축을 위해서는 체육행정 운영주체를 정부주도형에서 민간주도형으로 전환되어야할 것이다. 넷째, 국민체육진흥법 제43조(감독), 제44조(보고･검사)와 제22조(기금의 사용 등)의 개정을 통하여 체육단체의 역량강화를 위한 자율성과 재정능력이 확보되어야할 것이다.
The purpose of this research was to propose basic theories and proposals to help the creation of a future-oriented sports environment through improved propositions regarding the Korean positive laws and policies for the establishment of an advanced sports system. The Korean sports policy and legislations were re-lighted and the several improved amendments were proposed as the results for this research. The results of this study are as follows. First, it is analyzed that the most of Korean sports policies are mostly focused on structural and environmental issues only. Therefore there is a light lack of interests in the capacity building of sports organizations to realize them. Second, while the Korean Sports Promotion Act mainly stipulates structural functionalities for creating an environment for sports, the foundation clauses for enhancing the capacity of sports organizations in terms of organizational management was found to be poor relatively. Third, in order to improve of the sports system, the governing body of sports administration should be switched from organization from leading by government to leading by private. Fourth, the autonomy and financial ability are supposed to be strengthen the sports organizations through the through the revision of Article 43 (supervising), Article 44 (report and inspection) and Article 22 (Using of Fund, etc.) of the Korean Sports Promotion Act.
