The reasons include merit-basedism, the way professional sportsmen are nurtured, closed organizational culture, asymmetrical relations between leaders and athletes, factionalism and the powerful authority given to coaches. Sexual assault in sports in advanced countries such as Europe, the United States and Japan has become a social issue as it has sparked the #Me Too movement, and is seeking various countermeasures. Through a careful analysis of foreign systems, preventive measures and relief systems that conform to the cultural characteristics of our country should be created. In other words, it is necessary to establish a special law to ensure the human rights of sportsmen to provide specific means for defining and enforcing the rights of sportsmen, the composition and responsibilities of the nation and sports associations in detail, and the duties of sports organizations. As a means of post-mortem relief, the government proposes to introduce a punitive damages compensation system. This is because the benefits of being violated by sexual assault are far more significant than the legal benefits the current special law seeks to protect through punitive damages.
