최근 전 세계 주요 국가들은 자국의 카지노 산업 발전을 위해 복합리조트 육성을 중심으로 다양한 정책을 펼치고 있지만 국내 카지노 산업은 복합리조트화를 중심으로 한 카지노 산업의 세계적인 흐름에 동승하지 못하고 겉으로는 카지노 산업을 「관광진흥법」에서 규율하면서 관광산업의 하나로서 명시하고 있지만 실제로는 카지노 산업을 관광산업으로 접근하기 보다는 아직까지도 대표적인 사행산업으로 인식하고 카지노 산업에 대해 규제 일변도의 정책을 내놓으면서 오히려 세계적인 흐름에 역행하며 경쟁에서 도태되고 있는 실정이다. 이러한 상황에서 우리도 카지노 산업에 대한 전 세계적인 추세에 발맞추어 기존의 규제 일변도의 법제 시스템과 정책에서 벗어나 카지노 산업에 대한 전향적이고 새로운 접근과 함께 보다 근본적이고 통합적인 카지노 산업 관련 법제 및 정책을 마련하기 위해 기존의 카지노 산업 관련 법제 및 정책에 대한 정비 및 개선이 필요하다는 목소리가 높아지고 있다. 이에 본 논문에서는 현행 「관광진흥법」 및 카지노 관련 특별법의 개정과 별도의 카지노 산업 관련 단일법 제정 등의 입법론과 내국인의 출입이 가능한 오픈 카지노의 도입, MICE 산업과의 연계 등의 제도 및 정책적 개선방안을 중심으로 국내 카지노 산업의 발전을 위한 법제 개선방안에 대해 고찰해 보았다.
Recently, major countries around the world are carrying out various policies centering on fostering Integrated Resort for the development of their casino industry. However, the domestic casino industry does not come along with the global trend of the casino industry and recognizes the casino industry as a representative gambling industry. In this situation, we need to take a proactive and new approach to the casino industry in order to keep pace with the global trend in the casino industry and to move away from the existing legal systems and policies. In addition, it is necessary to improve and improve existing casino industry related laws and policies in order to establish fundamental and integrated casino industry related laws and policies. Thus, we have considered the improvement of the legal system for the development of domestic casino industry focusing on the legislative theory and system and policy improvement plan in this thesis.
