이 연구는 2019. 1. 15. 법률 제16225호로 개정되어 2020. 1. 16일자로 시행되는 국민체육진흥법 지방자치단체장의 체육단체장 겸직금지조항의 시행에 따른 문제점 및 그 효과를 분석하고 도출된 문제점에 대한 법 정책적인 대처방안을 살펴봄으로써 지방체육 활성화 및 스포츠선진화를 위한 기반 구축에 도움을 주는 데에 그 목적이 있다. 이 연구를 통해서 지방자치단체장의 체육단체장 금지조항 시행에 따른 예상 문제점을 SWOT환경 분석기법을 활용해 살펴본 결과, 관중심의 지방체육회에서 민간단체로의 성격 변화, 자율성과 독립성 강화 기회 확대, 지방자치정부와 지방체육회의 새로운 파트너십 구축 등의 긍정적인 기대효과와 지방체육 위축의 위험성 내재, 집단 간의 새로운 갈등 표출, 지방체육회의 공공성 약화 등의 부정적인 측면이 분석되었다. 이에 대한 대처방안으로써 지방체육회의 비영리법인화를 통한 공공성 확보, 안정적인 체육예산 확보 방안 마련, 지방체육진흥을 위한 법적 근거 강화 그리고 무엇보다도 겸직금지조항 시행에 따른 문제점을 보완하기 위해 발의된 국민체육진흥법 일부개정 법률안(의안번호 제2021514호, 2019. 7. 17)이 성공적으로 법제화되어야만 할 것이다.
This study was conducted and analyzed the problems and the effects of implementing on the amendment of the ban duty of sports organization head by local government chief(January 15, 2019 by the National Sports Promotion Act No. 16225, effective on January 16, 2020). The purpose of this study is to help establish the foundation for revitalizing local sports and promoting sports by looking at the legal policy measures against the government. Through this study, the SWOT environment analysis method was used to examine the anticipated problems caused of the prohibition of sports organization heads of local government chief. Positive effects such as the establishment of a new partnership with the government, the inherent risks of atrophy of local sports, the emergence of new conflicts among groups, and the weakness of the local sports community were analyzed. As the countermeasures, The publicity through the nonprofit organization of local sports associations, securing sports budgets stable, strengthening the legal basis for local sports promotion, and above all was proposed. Therefore, partial amendment of the National Sports Promotion Act proposed to supplement the problems associated with the enforcement of the prohibition on concurrent positions(was proposed amendment, Proposition No. 2021514, July 17, 2019), must be legislated and applied successfully.
