스포츠계 폭력의 문제는 어제 오늘의 일이 아니고 오래전부터 우리 사회의 병폐로 지적되면서 그 원인과 해결책을 제시하고자 하는 많은 노력이 있었으나 전혀 개선되지 않고 있다. 스포츠계에서는 폭행 등 가혹행위뿐만 아니라 성폭행도 버젓이 발생하고 있는데, 이와 같은 상황은 통계로도 확인된다. 최근 선수들에 대한 (성)폭행 및 가혹행위 등이 수면위로 드러나면서 많은 사람이 공분하였고, 정부는 뒤늦게야 관련 대책을 논의하고 법령을 정비하기 시작했다. 국민체육진흥법은 이를 배경으로 2020년에만 두 번에 걸쳐 대대적인 개정이 있었다. 이중 2020. 8. 18. 법률 제17480호로 개정된 국민체육진흥법은 스포츠윤리센터의 기능과 권한의 강화를 주된 내용으로 한다. 그러나 스포츠윤리센터가 스포츠비리 등에 대한 조사 권한이 있어도, 이를 강제할 수 없다는 점에서 그 실효성에 의문이 든다. 개정된 국민체육진흥법의 내용은 어느 정도 (성)폭행에 대한 예방이 될 수 있는 측면도 있으나, 그것은 근본적인 해결책이 될 수는 없다. 관련 전과를 체육지도자의 결격사유로 삼은 것을 제외하고는 모두 사후적 대책이다. 구조적으로 폭행은 성적을 지향하는 과정에서 잘못된 수단으로 행사되고 있고, 성폭행은 폐쇄된 공간에서 발생하고 있다. 그럼에도 여전히 선수들에게 합숙생활이 강요되고 있는 것으로 보인다. 이제는 성인여부를 불문하고, 지방이나 해외의 원정 경기 준비나 권위 있는 대회 준비 등의 사유를 제외하고는 합숙을 금지해야 한다고 본다. 그리고 지도자들에 대한 평가 기준 역시 객관적인 성적만을 고려할 것도 아니다. 이제는 더 이상 학원 및 실업 스포츠계의 변화를 미룰 수 없다. 좀 더 깊이 있는 논의로서 선수들의 인권과 지도자들의 경력 및 신분이 동시에 보장되는 시스템을 갖추어 지기를 기대하여 본다.
The problem of sports violence is not a matter of yesterday and today, and has been pointed out as a disease of our society for a long time, and many efforts have been made to suggest the cause and solution, but it has not been improved at all. In the sports world, sexual assault as well as harsh acts such as the above assaults are occurring. This situation is also confirmed by statistics. Recently, as (sex) assaults and harsh behaviors against players were revealed on the surface, and the people were angry, the government began to discuss related countermeasures and reorganize laws only late. Thus, the National Sports Promotion Act was revised twice in 2020 alone. Among them, the National Sports Promotion Act, amended by Act No. 17480 on August 18, 2020, has the main content of strengthening the functions and authority of the sports ethics center. However, even if the Sports Ethics Center has the authority to investigate sports corruption, the effectiveness of the sports ethics center is questioned in that it does not have a function to enforce it. The content of the revised National Sports Promotion Act has some aspects that can prevent (sexual) assault, but it cannot be a fundamental solution. All of them are post-mortem measures, except for the fact that the relevant criminal record was used as a reason for disqualification of the sports leader. Structurally, assault is being exercised by wrong means in the process of oriented sexuality, and sexual assault occurs in a closed space. Nevertheless, it seems that group life is still being forced on the players. Now, regardless of whether they are adults or not, group life should be banned except for reasons such as preparing for away games in local or foreign countries or preparing for prestigious competitions. And the criteria for evaluating leaders do not only consider objective grades. It is no longer possible to postpone the changes in the academy and vocational sports world. As a more in-depth discussion, I look forward to establishing a system that guarantees the human rights of players and the careers and status of leaders at the same time.
